AN ACT

Amending Title 23 (Domestic Relations) of the Pennsylvania

2

Consolidated Statutes, in child protective services, further

3

providing for education and training.

The General Assembly of the Commonwealth of Pennsylvania

5

hereby enacts as follows:

6

Section 1.  Section 6383(b) of Title 23 of the Pennsylvania

7

Consolidated Statutes is amended by adding a paragraph to read:

8

§ 6383.  Education and training.

(b)  Duties of Department of State.--

(3)  (i)  Each licensing board with jurisdiction over

13

professional licensees identified as mandated reporters

14

under this chapter shall require all persons applying for

15

the renewal of a license or certification issued by the

16

licensing board to submit documentation acceptable to the

17

licensing board of the completion of at least two hours

18

of approved continuing education, per licensure cycle,

regarding the identification and reporting of child abuse

2

obtained either from a provider approved by the licensing

3

board or by a preapproved provider outlined in

4

regulation.

(ii)  Each licensing board with jurisdiction over

6

professional licensees identified as mandated reporters

7

under this chapter may exempt an applicant or licensee

8

from the training requirement of this paragraph upon

9

receipt of a written application for an exemption

10

establishing that there is no need to complete the

11

training because the nature of the applicant's or

12

licensee's practice excludes contact with children. It is

13

the professional responsibility of the licensee who holds

14

an exemption to notify the applicable licensing board in

15

writing, within 30 days, when the nature of the practice

16

changes to the extent that the basis for the exemption

17

ceases to exist. The respective licensing boards shall

18

promulgate regulations within 18 months of the effective

19

date of this paragraph to meet these requirements.

Section 2.  The addition of 23 Pa.C.S. § 6383(b)(3) applies

21

to persons applying for the renewal of a license or

22

certification on or after January 1, 2014.

23

Section 3.  This act shall take effect in 60 days.
