AN ACT

Amending Title 18 (Crimes and Offenses) of the Pennsylvania

2

Consolidated Statutes, in firearms and other dangerous

3

articles, further providing for firearms not to be carried

4

without a license, for sale or transfer of firearms and for

5

antique firearms.

The General Assembly of the Commonwealth of Pennsylvania

7

hereby enacts as follows:

Section 1.  Section 6106(e) of Title 18 of the Pennsylvania

9

Consolidated Statutes is amended and the section is amended by

10

adding a subsection to read:

11

§ 6106.  Firearms not to be carried without a license.

12

(d.1)  Applicability to antique firearms.--The provisions of

14

this section shall apply to an antique firearm.

15

(e)  Definitions.--

16

(1)  For purposes of subsection (b)(3), (4), (5), (7) and

17

(8), the term "firearm" shall include any weapon which is

18

designed to or may readily be converted to expel any

19

projectile by the action of an explosive or the frame or

receiver of the weapon.

(2)  As used in this section, the phrase "place of

3

instruction" shall include any hunting club, rifle club,

4

rifle range, pistol range, shooting range, the premises of a

5

licensed firearms dealer or a lawful gun show or meet.

(3)  As used in this section, the phrase "antique

7

firearm" shall mean a firearm as defined in section 6102

8

(relating to definitions) that satisfies the definition of

9

"antique firearm" in section 6118 (relating to antique

10

firearms).

Section 2.  Sections 6111(e) and 6118 of Title 18 are amended

12

to read:

§ 6111.  Sale or transfer of firearms.

[(e)  Nonapplicability of section.--This section shall not

16

apply to the following:

17

(1)  Any firearm manufactured on or before 1898.

18

(2)  Any firearm with a matchlock, flintlock or

19

percussion cap type of ignition system.

20

(3)  Any replica of any firearm described in paragraph

21

(1) if the replica:

22

(i)  is not designed or redesigned to use rimfire or

23

conventional center fire fixed ammunition; or

24

(ii)  uses rimfire or conventional center fire fixed

25

ammunition which is no longer manufactured in the United

26

States and which is not readily available in the ordinary

27

channels of commercial trade.]

§ 6118.  Antique firearms.

(a)  General rule.--[This] Except as provided in section 6106

(relating to firearms not to be carried without a license), this 

2

subchapter shall not apply to antique firearms.

3

[(b)  Exception.--Subsection (a) shall not apply to the

4

extent that such antique firearms, reproductions or replicas of

5

firearms are concealed weapons as provided in section 6106

6

(relating to firearms not be carried without a license), nor

7

shall it apply to the provisions of section 6105 (relating to

8

persons not to possess, use, manufacture, control, sell or

9

transfer firearms) if such antique firearms, reproductions or

10

replicas of firearms are suitable for use.]

(c)  Definition.--As used in this section, the [term "antique

12

firearm" means:] following words and phrases shall have the

13

meanings given to them in this subsection:

14

"Antique firearm."  The term means:

15

(1)  Any firearm with a matchlock, flintlock or

16

percussion cap type of ignition system.

17

(2)  Any firearm manufactured on or before 1898.

18

(3)  Any replica of any firearm described in paragraph

19

(2) if such replica:

20

(i)  is not designed or redesigned for using rimfire

21

or conventional center fire fixed ammunition; or

22

(ii)  uses rimfire or conventional center fire fixed

23

ammunition which is no longer manufactured in the United

24

States and which is not readily available in the ordinary

25

channels of commercial trade.

26

"Firearm."  The term includes any weapon that is designed to

27

or may readily be converted to expel any projectile by the

28

action of an explosive or the frame or receiver of the weapon.

29

Section 3.  This act shall take effect in 60 days.
