AN ACT

Amending Title 61 (Prisons and Parole) of the Pennsylvania

Consolidated Statutes, providing for private correctional

facilities.

The General Assembly of the Commonwealth of Pennsylvania

hereby enacts as follows:

Section 1.  Title 61 of the Pennsylvania Consolidated

Statutes is amended by adding a section to read:

§ 1106.  Private correctional facilities.

(a)  Prohibition.--No private correctional facility may be

operated within this Commonwealth.

(b)  Continued operation.--Nothing in this section may

prevent the continued operation of any private correctional

facility that was in operation on the effective date of this

section.

(c)  Definitions.--As used in this section, the following

words and phrases shall have the meanings given to them in this

subsection unless the context clearly indicates otherwise:

"Private correctional facility."  A for-profit correctional

facility, prison or jail owned or operated by a private

contractor contracting with the Commonwealth for the provision

of correctional services. The term does not include a "community

corrections facility" as defined under section 4701 (relating to

definitions).

Section 2.  This act shall take effect immediately.
