AN ACT

  

1

Amending Titles 23 (Domestic Relations) and 42 (Judiciary and

2

Judicial Procedure) of the Pennsylvania Consolidated

3

Statutes, further providing for multidisciplinary team;

4

establishing the Child Abuse Multidisciplinary Response

5

Account; providing for additional duties of the Department of

6

Public Welfare and for distribution of funds; and further

7

providing for deposits into account.

8

The General Assembly of the Commonwealth of Pennsylvania

9

hereby enacts as follows:

10

Section 1.  Section 6365(b) of Title 23 of the Pennsylvania

11

Consolidated Statutes is amended to read:

12

§ 6365.  Services for prevention, investigation and treatment of

13

child abuse.

(b)  Multidisciplinary team.--The county agency shall make

16

available among its services a multidisciplinary team for the

17

prevention, investigation and treatment of child abuse and shall

18

convene the multidisciplinary team at any time, but not less

than annually:

2

(1)  To review substantiated cases of child abuse,

3

including responses by the county agency and other agencies

4

providing services to the child.

5

(2)  Where appropriate to assist in the development of a

6

family service plan for the child.

7

(3)  When appropriate to endorse an applicant seeking to

8

qualify for funding through the Child Abuse Multidisciplinary

9

Response Account pursuant to Subchapter F (relating to

10

multidisciplinary response to child abuse).

subchapter to read:

§ 6391.  Short title of subchapter.

25

This subchapter shall be known and may be cited as the

26

Children's Advocacy Center Funding Act.

27

§ 6392.  Declaration.

28

The General Assembly finds and declares as follows:

29

(1)  That the protection of children who have been abused

30

or neglected and who may be further threatened by the conduct

of persons responsible for their health, safety or welfare is

2

of paramount importance.

3

(2)  That in responding to a report of child abuse, the

4

best interests of the child shall be the highest priority.

5

(3)  That the best interests of a child who has been

6

abused or neglected are best met utilizing a

7

multidisciplinary response.

8

(4)  That a multidisciplinary response that effectively

9

utilizes the full panoply of services available through a

10

children's advocacy center provides a community-based,

11

comprehensive and coordinated child abuse intervention to

12

ensure that throughout the investigation and the ongoing

13

delivery of medical, social, legal and advocacy services to

14

the child, the child's best interests remain the priority.

§ 6393.  Definitions.

16

The following words and phrases when used in this subchapter

17

shall have the meanings given to them in this section unless the

18

context clearly indicates otherwise:

19

"Account" or "CAMRA."  The Child Abuse Multidisciplinary

20

Response Account established in section 6395(a) (relating to

21

establishment of Child Abuse Multidisciplinary Response

22

Account).

23

"Child abuse."  As defined in section 6303(b) (relating to

24

definitions), except that the term shall not be limited to acts

25

or omissions committed or alleged to have been committed by a

26

perpetrator.

27

"Eligible applicant."  A county agency and an applicant

28

endorsed by the county's multidisciplinary team and district

29

attorney.

30

"Lobbying activities."  Any effort to influence Federal,

State or local legislative or administrative action, including,

2

but not limited to, activities intended to influence the

3

issuance, amendment or revocation of any executive or

4

administrative order or regulation of a Federal, State or local

5

agency, or to influence the introduction, amendment, passage or

6

defeat of any legislation by the Congress of the United States

7

or by any State or local legislative body.

8

"Multidisciplinary response."  A response to suspected child

9

abuse in which child protective services, law enforcement,

10

prosecution, victim support and advocacy agencies and medical

11

and mental health professionals cooperate pursuant to a written

12

protocol to provide coordinated intervention that assures that

13

children are connected to services that are necessary to provide

14

for their safety, health and well-being, and that as part of the

15

coordinated response, children are interviewed regarding the

16

suspected child abuse in a coordinated and child-focused manner

17

to avoid duplication of fact-finding and to minimize additional

18

trauma to the child.

19

"Multidisciplinary team."  A multidisciplinary team

20

established in a county as required by section 6365 (relating to

21

services for prevention, investigation and treatment of child

22

abuse).

23

§ 6394.  Additional eligibility requirements.

24

(a)  Criteria.--The district attorney shall develop criteria

25

for use by the multidisciplinary team in determining whether an

26

applicant should be endorsed by the multidisciplinary team

27

pursuant to section 6365(b)(3) (relating to services for

28

prevention, investigation and treatment of child abuse). The

29

criteria may include whether an applicant meets or is striving

30

to meet national or State standards for accreditation as a

children's advocacy center.

(b)  Procedure.--The following apply:

3

(1)  An applicant must be endorsed by the

4

multidisciplinary team and district attorney in order for the

5

applicant to receive funds under this subchapter. The

6

district attorney and the multidisciplinary team shall make a

7

decision regarding whether to endorse an applicant by

8

applying the criteria developed by the district attorney

9

under subsection (a). In no case shall the department

10

disburse funds to an applicant that has not been endorsed by

11

the district attorney and multidisciplinary team.

12

(2)  Once endorsed by the district attorney and

13

multidisciplinary team, the county agency and applicant shall

14

be deemed an eligible applicant. The eligible applicant shall

15

file a joint application with the department for funding

16

under this subchapter.

17

(3)  In a county of the first or second class there shall

18

be no more than two eligible applicants in each county, and

19

in all other classes of counties there shall be no more than

20

one eligible applicant per county.

21

(4)  The department shall administer the account and

22

establish procedures for approving applications submitted by

23

eligible applicants and for distributing funds to eligible

24

applicants pursuant to this section.

25

§ 6395.  Establishment of Child Abuse Multidisciplinary Response

26

Account.

27

(a)  Establishment.--There is established in the State

28

Treasury a nonlapsing restricted receipt account to be known as

29

the Child Abuse Multidisciplinary Response Account (CAMRA) for

30

the deposit of the additional fees as provided in 42 Pa.C.S. §

3733(a.1)(2)(iv) (relating to deposits into account).

(b)  Additional resources.--If additional Federal resources

3

are made available for purposes in accordance with this

4

subchapter, every effort shall be made to include children's

5

advocacy centers in the funding plans submitted by the

6

department to the Federal Government.

7

§ 6396.  Purpose of account.

8

(a)  Permitted use.--

9

(1)  Except as provided in subsection (b), all money in

10

the account and any investment income accrued shall be used

11

exclusively to provide additional resources to eligible

12

applicants in the form of nonmatching grants.

13

(2)  Additional Federal resources made available under

14

section 6395(b) (relating to establishment of Child Abuse

15

Multidisciplinary Response Account) shall be utilized in

16

accordance with federally approved funding plans that were

17

submitted by the department under section 6395(b).

18

(b)  Additional permitted use.--In addition to subsection

19

(a), money in the account shall be used for the following

20

purposes:

21

(1)  To reimburse the department for any initial actual

22

costs necessary to implement this subchapter. The department

23

shall be reimbursed before distributing any funds to eligible

24

applicants.

25

(2)  To reimburse the department annually for actual

26

costs when fulfilling its duties under this subchapter. In no

27

case may the department annually receive more than 2% of the

28

funds deposited in the account.

29

(c)  Appropriation.--All money deposited in the Child Abuse

30

Multidisciplinary Response Account, and any investment income

accrued is annually appropriated to the department for the

2

purposes set forth in this section. Distribution shall be made

3

annually upon requisition of the secretary.

4

(d)  Grants.--Funds from the account shall be disbursed to

5

all eligible applicants that apply, to the extent that funds are

6

available in the account. No more than 20% of the funds in the

7

account annually shall be granted to one eligible applicant. For

8

the first three years after the account is established, the

9

department shall endeavor to grant 20% of the account to

10

eligible applicants working to establish children's advocacy

11

centers in counties not yet served by a children's advocacy

12

center.

13

(e)  Prohibited use.--Recipients of funds under this

14

subchapter are prohibited from using these funds to contribute

15

to or be made available to any political party or association or

16

the campaign of any candidate for public or party office or

17

similar political activities or to support or oppose candidates

18

for public or party office or to support or oppose any ballot

19

questions or to engage in lobbying activities, except that a

20

recipient of funds may engage in lobbying activities in response

21

to a request from a governmental agency, legislative body,

22

committee, member or staff thereof made to the recipient.

23

Section 3.  Section 3733(a.1) of Title 42 is amended to read:

24

§ 3733.  Deposits into account.

25

(a.1)  Additional fees.--

27

(1)  In addition to the court costs and filing fees

28

authorized to be collected by statute:

29

(i)  An additional fee of [$10] $12 shall be charged

30

and collected by the prothonotaries of the Pennsylvania

Supreme, Superior and Commonwealth Courts for each

2

initial filing for which a fee, charge or cost is now

3

authorized.

4

(ii)  An additional fee of $10 shall be charged and

5

collected by the prothonotaries, clerks of orphans'

6

courts and registers of wills of all courts of common

7

pleas, or by any officials designated to perform the

8

functions thereof, for the initiation of any civil action

9

or legal proceeding.

10

(iii)  An additional fee of [$10] $12 shall be

11

charged by the clerks of courts of all courts of common

12

pleas, or by any officials designated to perform the

13

functions thereof, for the initiation of any criminal

14

proceeding for which a fee, charge or cost is now

15

authorized and a conviction is obtained or guilty plea is

16

entered. The additional fee under this subparagraph shall

17

also be charged and collected when a defendant is granted

18

entry into Accelerated Rehabilitative Disposition or any

19

other pretrial diversionary program.

20

(iv)  An additional fee of $10 shall be charged and

21

collected by the minor judiciary, including magisterial

22

district judges, Philadelphia Municipal Court,

23

Philadelphia Traffic Court and Pittsburgh  Municipal 

24

Court, for the initiation of a legal proceeding for which

25

a fee or cost is now authorized, except that in criminal,

26

summary and traffic matters the fee shall be charged only

27

when a conviction is obtained or guilty plea is entered.

28

The additional fee under this subparagraph shall also be

29

charged and collected when a defendant is granted entry

30

into Accelerated Rehabilitative Disposition or any other

pretrial diversionary program.

2

(v)  An additional fee of $10 shall be charged and

3

collected by the recorders of deeds and clerks of court,

4

or by any officials designated to perform similar

5

functions, for each filing of a deed, mortgage or

6

property transfer for which a fee, charge or cost is now

7

authorized. The Supreme Court shall designate by

8

financial regulations which filings meet the criteria of

9

this subparagraph.

10

(2)  The additional fees identified in paragraph (1)

11

shall be fixed and charged for the fiscal years as indicated:

12

(i)  For the fiscal year 2002-2003, $9 of each

13

additional fee shall be deposited into the Judicial

14

Computer System Augmentation Account, and $1 of each

15

additional fee shall be deposited into the Access to

16

Justice Account under section 4904 (relating to

17

establishment of Access to Justice Account).

18

(ii)  For the fiscal years 2003-2004 and 2004-2005,

19

$8.50 of each additional fee shall be deposited into the

20

Judicial Computer System Augmentation Account, and $1.50

21

of each additional fee shall be deposited into the Access

22

to Justice Account under section 4904.

23

(iii)  For the fiscal year 2005-2006 and each fiscal

24

year thereafter, except as provided in subparagraph (iv),

25

$8 of each additional fee shall be deposited into the

26

Judicial Computer System Augmentation Account, and $2 of

27

each additional fee shall be deposited into the Access to

28

Justice Account under section 4904.

29

(iv)  Each additional fee collected in paragraph (1)

30

(i) and (ii) shall be deposited as follows:

(A)  $8 of the additional fee shall be deposited

2

into the Judicial Computer System Augmentation

3

Account;

4

(B)  $2 of the additional fee shall be deposited

5

into the Access to Justice Account under section

6

4904; and

7

(C)  $2 of the additional fee shall be deposited

8

into the Child Abuse Multidisciplinary Response

9

Account established under 23 Pa.C.S. § 6395 (relating

10

to establishment of Child Abuse Multidisciplinary

11

Response Account).

12

(3)  The moneys charged and collected under this

13

subsection shall be paid to the court imposing the fee, which

14

shall transfer the moneys to the Department of Revenue for

15

deposit into the appropriate account. For the purposes of

16

paragraph (1)(v), the court shall be the court of common

17

pleas.

18

Section 4.  This act shall take effect in 90 days.
