AN ACT

Amending Title 42 (Judiciary and Judicial Procedure) of the

2

Pennsylvania Consolidated Statutes, further providing for

3

Commonwealth portion of fines, etc.

The General Assembly of the Commonwealth of Pennsylvania

5

hereby enacts as follows:

6

Section 1.  Section 3571(b)(2) of Title 42 of the

7

Pennsylvania Consolidated Statutes is amended to read:

8

§ 3571.  Commonwealth portion of fines, etc.

(b)  Vehicle offenses.--

(2)  (i)  Except as provided in paragraph (4), when

13

prosecution under any other provision of Title 75

14

(relating to vehicles) is the result of State Police

15

action, all fines, forfeited recognizances and other

16

forfeitures imposed, lost or forfeited shall be payable

17

to the Commonwealth, for credit to the Motor License

Fund. One-half of the revenue shall be paid to

2

municipalities as designated in subparagraph (ii) in the

3

same ratio provided in section 4 of the act of June 1,

4

1956 (P.L.1944, No.655), relating to partial allocation

5

of liquid fuels and fuel use tax proceeds.

6

(ii)  (A)  Except as provided in clause (B), only

7

municipalities that provide local police services

8

through a municipal police department, participation

9

in a regional police department or contracts with

10

other municipal or regional police for police

11

services may receive revenue under subparagraph (i).

12

(B)  Municipalities that do not provide local

13

police services as listed under clause (A) shall be

14

paid revenue under subparagraph (i) in the following

15

amounts:

16

(I)  In the first year after the effective

17

date of this subparagraph, 50% of the amount paid

18

to the municipality under subparagraph (i).

19

(II)  In the second year after the effective

20

date of this subparagraph, 25% of the amount paid

21

to the municipality under subparagraph (i).

22

(III)  In the third year after the effective

23

date of this subparagraph and each year

24

thereafter, no amount shall be paid to the

25

municipality under subparagraph (i).

(C)  Revenue that is not paid to municipalities

27

under clause (B) shall be transferred to the

28

Pennsylvania State Police for cadet classes.

Section 2.  This act shall take effect in 60 days.
