| AN ACT |
| |
1 | Amending Title 75 (Vehicles) of the Pennsylvania Consolidated |
2 | Statutes, further providing for immediate notice of accident |
3 | to police department. |
4 | The General Assembly of the Commonwealth of Pennsylvania |
5 | hereby enacts as follows: |
6 | Section 1. Section 3746 of Title 75 of the Pennsylvania |
7 | Consolidated Statutes is amended to read: |
8 | § 3746. Immediate notice of accident to police department. |
9 | (a) General rule.--The driver of a vehicle involved in an |
10 | accident shall immediately by the quickest means of |
11 | communication give notice to the nearest office of a duly |
12 | authorized police department if the accident involves: |
13 | (1) injury to or death of any person; or |
14 | (2) damage to any vehicle involved to the extent that it |
15 | cannot be driven under its own power in its customary manner |
16 | without further damage or hazard to the vehicle, other |
17 | traffic elements, or the roadway, and therefore requires |
18 | towing. |
19 | (b) Duty of occupant if driver disabled.--Whenever the |

1 | driver of a vehicle is physically incapable of giving an |
2 | immediate notice of an accident as required in subsection (a) |
3 | and there is another occupant in the vehicle at the time of the |
4 | accident capable of doing so, the occupant shall make or cause |
5 | to be given the notice not given by the driver. |
6 | (c) Investigation by police officer.--Every accident |
7 | reported to a police department [required in this section] shall |
8 | be investigated by a police officer who shall physically report |
9 | to the scene of the accident and shall provide each driver a |
10 | signed statement that the accident was reported. |
11 | Section 2. This act shall take effect in 60 days. |
