| AN ACT |
| |
1 | Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An |
2 | act relating to the public school system, including certain |
3 | provisions applicable as well to private and parochial |
4 | schools; amending, revising, consolidating and changing the |
5 | laws relating thereto," in school finances, further providing |
6 | for distress in school districts of the first class. |
7 | The General Assembly of the Commonwealth of Pennsylvania |
8 | hereby enacts as follows: |
9 | Section 1. Section 696 of the act of March 10, 1949 (P.L.30, |
10 | No.14), known as the Public School Code of 1949, is amended by |
11 | adding a subsection to read: |
12 | Section 696. Distress in School Districts of the First |
13 | Class.--* * * |
14 | (n.3) (1) At the first primary, special or general election |
15 | that occurs at least ninety (90) days after the effective date |
16 | of this subsection, a binding referendum question shall be |
17 | presented to the electors of the school district of the first |
18 | class, which referendum shall ask, as a single ballot question, |
19 | whether the School Reform Commission shall be dissolved and the |
20 | members of the board of school directors for the school district |

1 | shall be elected, on a nonpartisan basis, by the qualified |
2 | electors. |
3 | (2) If a majority of the qualified electors votes in favor |
4 | of the dissolution of the School Reform Commission and the |
5 | public election of members of the board of school directors, |
6 | then the dissolution shall be effective at least one hundred |
7 | eighty (180) days prior to the end of the current school year |
8 | and shall be effective at the end of that school year. |
9 | (3) The election of members of the board of school directors |
10 | shall occur as soon as practicable in order for the elected |
11 | members to take office prior to the commencement of the |
12 | following school year. |
