AN ACT

Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An

2

act relating to the public school system, including certain

3

provisions applicable as well to private and parochial

4

schools; amending, revising, consolidating and changing the

5

laws relating thereto," in school districts, further

6

providing for value-added assessment system.

The General Assembly of the Commonwealth of Pennsylvania

8

hereby enacts as follows:

Section 1.  Section 221 of the act of March 10, 1949 (P.L.30,

10

No.14), known as the Public School Code of 1949, added November

11

17, 2010 (P.L.996, No.104), is amended to read:

Section 221.  Value-added Assessment System.--(a)  Beginning

13

on the effective date of this section, the Department of

14

Education shall make available on its publicly accessible

15

Internet website the following:

16

(1)  Value-added assessment system data, consisting of

17

academic growth and projections for achievement on future

18

assessments, for the school district level [and], the school

19

level, the grade level, the classroom level and the teacher

20

level. The Department of Education's disclosure of value-added

assessment system data shall be subject to the Family

2

Educational Rights and Privacy Act of 1974 (Public Law 90-247,

3

20 U.S.C. § 1232g) or a successor Federal statute.

(2)  Instructions that may assist the public in understanding

5

and interpreting the data provided under paragraph (1).

(b)  For purposes of this section:

7

"Value-added assessment system" shall mean a statistical

8

analysis of results on the Pennsylvania System of School

9

Assessment test or any other test established by the State Board

10

of Education to meet the requirements of section 2603-B(d)(10)

11

(i) pursuant to 22 Pa. Code § 403.3 (relating to single

12

accountability system) that uses measures of student learning to

13

enable the estimation of student, teacher, classroom, grade, 

14

school or school district statistical distributions.

15

Section 2.  This act shall take effect in 60 days.
