AN ACT

Amending the act of June 13, 1967 (P.L.31, No.21), entitled "An

2

act to consolidate, editorially revise, and codify the public

3

welfare laws of the Commonwealth," in public assistance,

4

further providing for meeting special needs, work supports

5

and incentives, and establishing the Job Transition Loan

6

Fund.

7

The General Assembly of the Commonwealth of Pennsylvania

8

hereby enacts as follows:

9

Section 1.  Section 408 of the act of June 13, 1967 (P.L.31,

10

No.21), known as the Public Welfare Code, amended May 16, 1996

11

(P.L.175, No.35), is amended to read:

12

Section 408.  Meeting Special Needs; Job Transition Loans; 

13

Work Supports and Incentives.--(a)  The department shall take

14

measures not inconsistent with the purposes of this article; and

15

when other funds or facilities for such purposes are inadequate

16

or unavailable to provide for special needs of individuals

17

eligible for assistance; to relieve suffering and distress

arising from disabilities and infirmities; to promote their

2

rehabilitation; to help them if possible to become self-

3

dependent; and, to cooperate to the fullest extent with other

4

public agencies empowered by law to provide rehabilitative or

5

similar services.

6

(b)  The department may provide assistance to recipients for

7

child day care when the department has determined that without

8

such services the recipient would be exempt from compliance with

9

the conditions of the agreement of mutual responsibility or work

10

requirements or when a former recipient who is employed has

11

ceased to receive cash assistance for a reason other than a

12

sanction for noncompliance with an eligibility condition. In

13

establishing the time limits and levels of access to child day-

14

care funds, the department shall take into account availability,

15

costs and the number of assistance groups needing services

16

within the geographic area and shall seek to provide essential

17

services to the greatest number of recipients.

18

(c)  The department may provide the following assistance to

19

recipients for [transportation and] work support as delineated

20

in this subsection when the department has determined that

21

without such [services] assistance the recipient would be exempt

22

from compliance with the conditions of the agreement of mutual

23

responsibility or work requirements. [In establishing the time

24

limits and levels of access to transportation and work support,

25

the department shall take into account availability, costs and

26

the number of recipients needing services within the geographic

27

area and shall seek to provide essential services to the

28

greatest number of recipients.] The assistance to be provided

29

under this subsection must be made in accordance with

30

subsections (d) and (e) and directly related to employment,

education, training, job interviews or work-related activities,

which may include:

3

(1)  Clothing costs.

4

(2)  Testing fee.

5

(3)  Union dues or professional fee.

6

(4)  Books, tools and supplies for education or training

purposes.

(5)  Transportation, limited to:

9

(i)  Public transportation. Payment may only be made for

10

transportation provided by bus, subway, commuter rail, taxi or

11

paratransit.

12

(ii)  Private transportation. Payment may only be made for

13

costs incurred for transportation provided by privately owned

14

vehicles, mileage reimbursement, ride sharing and car or van

pools.

16

(iii)  Personal transportation. Payment may only be made for

17

vehicle repairs, vehicle purchase and other expenses related to

18

a recipient-owned vehicle.

19

(d)  The department shall make interest-free job transition

20

loans available to recipients for the payment for items under

21

subsection (c)(1), (2), (3), (4) or (5)(iii) in accordance with

22

paragraph (1).

23

(1)  The department may authorize a loan under this

24

subsection provided that all of the following are satisfied:

25

(i)  The loan is preapproved by the department.

26

(ii)  The terms of the loan and repayment schedule are

27

enumerated in a promissory note representing the final written

28

expression of the loan agreement between the recipient and the

29

department.

(iii)  The promissory note is signed by the recipient prior

to disbursement.

(iv)  The loan disbursement is made directly to the payee,

3

upon receipt of an invoice.

4

(v)  The total outstanding loan amount made to an assistance

5

unit does not exceed two thousand dollars ($2,000).

6

(vi)  The term of the loan does not exceed twenty-four

7

months.

8

(vii)  The loan is governed by Pennsylvania law.

9

(viii)  The department reports on each loan to the major

10

credit reporting agencies.

11

(2)  The department shall promulgate rules providing for the

12

following:

13

(i)  The terms and conditions of repayment. The rules

14

promulgated under this subsection shall provide for job

transition credits allowing recipients to reduce the total

16

outstanding loan amount by fifty dollars ($50) for every

17

subsequent month the recipient does not require cash assistance

18

or food stamps and for loan forgiveness for a recipient who does

19

not require cash assistance or food stamps for eighteen months

20

subsequent to the disbursement of the loan. for:

(A)  Job transition credits allowing recipients to reduce the

22

total outstanding loan amount by an amount equal to the monthly

23

loan repayment amount for every subsequent month the cash

24

assistance recipient does not require cash assistance or the

25

food stamps recipient does not require food stamps.

26

(B)  Loan forgiveness for the cash assistance recipient who

27

does not require cash assistance for eighteen months subsequent

28

to the disbursement of the loan or for the food stamp recipient

29

who does not require food stamps for eighteen months subsequent

30

to the disbursement of the loan.

(ii)  The penalties and sanctions for late payments,

2

nonrepayment or loan default. The department shall maintain a

3

security interest in the loan. In the event of loan default, the

4

department may liquidate its security interest.

5

(iii)  The application process and guidelines for determining

6

the creditworthiness of a recipient.

7

(iv)  The standard form promissory note.

8

(3)  The department may enter into agreements or contracts

9

with other executive departments, nonprofit organizations or

10

private entities as needed to implement or manage the job

11

transition loan program.

12

(4)  When practical, the department shall arrange for loan

13

installments to be deducted from cash assistance amounts.

14

(5)  Only the secretary may authorize modification,

15

rescission or waiver of the promissory note.

16

(e)  The department may make payments under subsection

17

(c)(5)(i) and (ii) provided that all of the following are

18

satisfied for each payment:

19

(1)  The payment is not made directly to a recipient, except

when the payment is made for mileage reimbursement for the

21

recipient's own vehicle.

22

(2)  The payment is made directly to the payee, upon receipt

23

of an invoice.

24

(3)  The payment has been preapproved by the department.

25

(f)  Under this section, the department may not:

26

(1)  authorize a job transition loan except as provided by

27

subsection (d) or pay for items or services except as provided

28

by subsection (e); or

29

(2)  pay for items or services under subsection (c)(5)(i) or

30

(ii) for a period beyond the recipient's first pay.

(g)  The department shall retain documentation of payments

2

and loans under this section.

(h)  The department shall submit an annual report to the

4

Majority Leader of the Senate, the Minority Leader of the

5

Senate, the chair and minority chair of the Public Health and

6

Welfare Committee of the Senate, the chair and minority chair of

7

the Appropriations Committee of the Senate, the Majority Leader

8

of the House of Representatives, the Minority Leader of the

9

House of Representatives, the chair and minority chair of the

10

Health Committee of the House of Representatives and the chair

11

and minority chair of the Appropriations Committee of the House

12

of Representatives. The report shall contain information

13

relating to:

14

(1)  the implementation of this section;

15

(2)  the number of recipients receiving assistance under this

16

section; and

17

(3)  the type of assistance provided under this section.

18

(i)  Assistance to be provided under this section shall be

19

limited to funds appropriated to the department for special

20

allowances.

21

(j)  The Job Transition Loan Fund is established within the

22

State Treasury as a special fund to which shall be credited all

23

appropriations made by the General Assembly for the purpose of

24

providing job transition loans as well as repayment of loans

25

made under this section. The department shall routinely

26

requisition from the Job Transition Loan Fund such amounts as

27

shall be allocated by the department for loans to recipients.

28

When and as the amounts so allocated as loans to recipients are

29

repaid pursuant to the terms of the agreements made and entered

30

into with the department, the department shall pay such amounts

into the Job Transition Loan Fund, it being the intent of this

2

subsection that the Job Transition Loan Fund shall operate as a

3

revolving fund whereby all appropriations and payments made

4

thereto may be applied and reapplied to the purposes of

5

providing loans under this section.

Section 2.  Any regulations inconsistent with the amendment

7

of section 408 of the act are abrogated.

8

Section 3.  This act shall take effect in 60 days.
