| AN ACT |
| |
1 | Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An |
2 | act relating to the public school system, including certain |
3 | provisions applicable as well to private and parochial |
4 | schools; amending, revising, consolidating and changing the |
5 | laws relating thereto," in intermediate units, further |
6 | providing for subsidies for services and for financial |
7 | reports. |
8 | The General Assembly of the Commonwealth of Pennsylvania |
9 | hereby enacts as follows: |
10 | Section 1. Section 907-A of the act of March 10, 1949 |
11 | (P.L.30, No.14), known as the Public School Code of 1949, added |
12 | May 4, 1970 (P.L.311, No.102), is amended to read: |
13 | Section 907-A. Subsidies for Services.--(a) Intermediate |
14 | units shall receive subsidies from the Commonwealth as herein |
15 | provided only for services performed pursuant to and authorized |
16 | by law, as hereinafter provided. Nothing contained herein shall |
17 | prohibit intermediate units from receiving funds from school |
18 | districts and other sources including nonpublic nonprofit |
19 | schools and expending such funds to provide additional services |

1 | not included in the approved program of services. |
2 | (b) (1) No later than February 1, 2012, and each year |
3 | thereafter, the intermediate units shall submit to the |
4 | Department of Education a report on subsidies and funds received |
5 | under this section. The report shall include, but not be limited |
6 | to, the following information: |
7 | (i) A listing of all contracts, interagency agreements and |
8 | purchase orders executed by a Commonwealth agency with each |
9 | intermediate unit. |
10 | (ii) The total amount, including annual amount for any |
11 | multiyear contract, agreement or purchase order, and the |
12 | duration of each. |
13 | (iii) The source and amount of funding to cover the entire |
14 | cost of the contract. |
15 | (iv) A description of programs and services being provided, |
16 | including performance measures by which each intermediate unit |
17 | will be assessed and penalties for nonperformance, if any. |
18 | (v) A description of the selection process used in entering |
19 | into the arrangement. |
20 | (vi) The number of all employes, contractors and agents |
21 | covered under the contracts and the remuneration provided under |
22 | the contract. |
23 | (2) The Department of Education shall develop the format to |
24 | be used by the intermediate unit in the collection of the |
25 | information specified in paragraph (1). |
26 | (3) The Department of Education shall post the reports on |
27 | the department's Internet website. |
28 | (4) The report shall cover fiscal year 2009-2010. |
29 | Section 2. Section 921-A of the act is amended by adding a |
30 | subsection to read: |

2 | (a.1) The Department of Education shall post on its Internet |
3 | website, in the format consistent with those already posted for |
4 | the other local education agencies, information included in the |
5 | intermediate units' annual financial report. |

7 | Section 3. This act shall take effect in 60 days. |
