AN ACT

Amending the act of August 15, 1961 (P.L.987, No.442), entitled

2

"An act relating to public works contracts; providing for

3

prevailing wages; imposing duties upon the Secretary of Labor

4

and Industry; providing remedies, penalties and repealing

5

existing laws," excluding political subdivisions from the

6

act; and authorizing optional prevailing wage ordinances.

The General Assembly of the Commonwealth of Pennsylvania

8

hereby enacts as follows:

Section 1.  Section 2(4) of the act of August 15, 1961

10

(P.L.987, No.442), known as the Pennsylvania Prevailing Wage

11

Act, is amended to read:

Section 2.  Definitions.--As used in this act--

13

(4)  "Public body" means the Commonwealth of Pennsylvania,

15

[any of its political subdivisions,] any authority created by

16

the General Assembly of the Commonwealth of Pennsylvania and any

17

instrumentality or agency of the Commonwealth of Pennsylvania,

but shall not include a political subdivision or any authority,

2

agency or instrumentality created by one or more political

3

subdivisions.

Section 2.  The act is amended by adding a section to read:

Section 15.1.  Local Option.--Notwithstanding any provision

7

of this act, a political subdivision or an authority, agency or

8

instrumentality of a political subdivision may elect, by

9

ordinance or resolution, to place itself within the jurisdiction

10

of this act.

Section 3.  All acts and parts of acts are repealed insofar

12

as they are inconsistent with this act.

13

Section 4.  This act shall take effect in 60 days.
