AN ACT

Providing for the disclosure and reporting of independent

2

expenditures for certain political communication and for a

3

penalty.

4

The General Assembly finds and declares as follows:

5

(1)  The timely disclosure of the person that pays for a

6

communication to the citizens of this Commonwealth that

7

attempts to influence the outcome of an election is essential

8

to maintaining the integrity of the electoral process.

9

(2)  The General Assembly has a compelling interest in

10

ensuring that the citizens of this Commonwealth know who pays

11

for communication that attempts to influence the outcome of

12

an election.

13

(3)  The use of an individual's name or likeness in a

14

communication that is made in close proximity to an election

15

is presumed to attempt to influence the outcome of the

16

election, regardless of whether the communication explicitly

17

advocates for or against the individual.

The General Assembly of the Commonwealth of Pennsylvania

hereby enacts as follows:

3

Section 1.  Short title.

4

This act shall be known and may be cited as the Political

5

Communication Disclosure and Reporting Act.

6

Section 2.  Definitions.

7

The following words and phrases when used in this act shall

8

have the meanings given to them in this section unless the

9

context clearly indicates otherwise:

10

"Candidate."  An individual who seeks nomination, election or

11

re-election to elective office. An individual shall be deemed to

12

be seeking nomination, election or re-election if he has done

13

either of the following:

14

(1)  Received a contribution or made an expenditure or

15

has given his consent for any other person or committee to

16

receive a contribution or make an expenditure for the purpose

17

of influencing his nomination, election or re-election to

18

elective office, whether or not the individual has made known

19

the specific office for which he will seek nomination,

20

election or re-election at the time the contribution is

21

received or the expenditure is made.

(2)  Taken the action necessary under the laws of this

23

Commonwealth to qualify himself for nomination, election or

24

re-election to elective office.

25

"Communications medium."  The term includes a newspaper,

26

magazine, book, newsletter, pamphlet, circular, flyer, brochure,

27

letter, billboard, telephone, radio, television, recording,

28

computer software, transit ad, audiovisual work or global

29

communications network, including a social media network.

30

"Contribution."  The term shall have the meaning given to it

under section 1621 of the act of June 3, 1937 (P.L.1333,

2

No.320), known as the Pennsylvania Election Code.

"Department."  The Department of State of the Commonwealth.

4

"Election."  A general, special, municipal or primary

5

election. The term shall include any election at which a

6

question appears on the ballot.

7

"Election Code."  The act of June 3, 1937 (P.L.1333, No.320),

8

known as the Pennsylvania Election Code.

9

"Elective office."  A position in a governmental body to

10

which an individual is required under the Constitution of

11

Pennsylvania or by State law to be elected by the public.

12

"Governmental body."  The executive, legislative or judicial

13

branch of the Commonwealth or a political subdivision of the

14

Commonwealth.

15

"Independent expenditure."  Any of the following:

16

(1)  An expenditure made for a political communication

17

which was not approved, authorized, requested or suggested by

18

the candidate referred to, pictured or mentioned in the

19

communication, the candidate's political committee or a

20

representative of a candidate or the candidate's political

21

committee.

22

(2)  An expenditure made for a political communication

23

that promotes the success or defeat of a ballot question. 

24

"Name" or "likeness."  Any attribute of an individual that

25

serves to identify the individual to an ordinary, reasonable

26

viewer or listener, including name, signature, photograph, image

27

or voice or a substantially similar imitation of one or more of

28

those attributes.

"Political committee."  The term shall have the meaning given

30

to it in section 1621 of the act of June 3, 1937 (P.L.1333,

No.320), known as the Pennsylvania Election Code.

"Political communication."  A message disseminated through a

3

communications medium which expressly advocates for or against

4

the election of a clearly identified candidate or the success or

5

defeat of a ballot question. A message disseminated through a

6

communications medium within 60 days prior to an election that

7

includes the name or likeness of a candidate shall be presumed

8

to be a political communication, whether or not it expressly

9

advocates for or against the election of a clearly identified

10

candidate and whether or not it was approved, authorized,

11

requested or suggested by the candidate, the candidate's

12

political committee or a representative of the candidate or the

13

candidate's committee. The term shall not include the following:

14

(1)  A story, commentary or editorial published by a news

15

outlet regularly available to the public, regardless of the

16

communications medium used, unless the outlet is owned or

17

controlled by any of the following:

18

(i)  A candidate, the candidate's political committee

19

or a representative of the candidate or the candidate's

20

political committee.

21

(ii)  A political committee formed to promote the

22

success or defeat of a ballot question or a

23

representative of such political committee.

24

(iii)  A political organization.

25

(2)  A candidate debate or a candidate forum.

26

(3)  A communication that costs less than $1,000.

27

"Political organization."  An organization not recognized as

28

a political party or political body under the act of June 3,

29

1937 (P.L.1333, No.320), known as the Pennsylvania Election

30

Code.

"Sponsor."  A person who pays for a political communication.

Section 3.  Registration requirements.

3

No political communication shall be disseminated in this

4

Commonwealth that is paid for or intended to be paid for by an

5

independent expenditure until the sponsor of the political

6

communication registers with the department on a form and in a

7

manner prescribed by the department.  

8

Section 4.  Disclosure and reporting of independent

9

expenditures.

10

(a)  Disclosure requirements.--A political communication that

11

is paid for by an independent expenditure shall clearly state

12

the name of the sponsor and the person who published or

13

distributed the political communication and shall clearly and

14

conspicuously state that the communication is not authorized by

15

or made in concert with or requested by the candidate mentioned,

16

pictured or referred to in the communication, the candidate's

17

political committee or by a representative of the candidate or

18

the candidate's political committee.

19

(b)  Reporting requirements.--A person required to register

20

under section 3 shall file all reports of receipts and

21

expenditures required of political committees under the Election

22

Code. Notwithstanding any provision of the Election Code to the

23

contrary, an independent expenditure made for a political

24

communication after the final pre-election report is filed shall

25

be reported to the department within 24 hours following the

26

making of the independent expenditure. The report may be filed

27

via electronic mail or in the same form and manner required for

28

the reporting of late contributions and independent expenditures

29

by a candidate or a candidate's political committee under

30

section 1628 of the Election Code.

(c)  Content of report.--In addition to any other

2

requirements of the Election Code, the report required under

3

subsection (b) shall include all of the following:

4

(1)  The name and address of the person filing the

5

report.

6

(2)  The name and address of the sponsor.

7

(3)  The name of the person making the independent

8

expenditure, if not the sponsor.

9

(4)  The amount of the independent expenditure.

10

(5)  The name and address of the person or entity

11

receiving the payment of the independent expenditure and the

12

date of the payment.

13

(6)  The name and address of any person making a

14

contribution of $100 or more for the independent expenditure

15

or the provision of goods or services for such expenditure.

16

(7)  The date the political communication was first

17

published, broadcast, transmitted, mailed, erected or

18

otherwise distributed.

19

(8)  The election to which the independent expenditure

20

pertains.

21

(9)  The name of each candidate identified in the

22

political communication, the office sought by each candidate

23

and the amount of the independent expenditure attributable to

24

each candidate.

25

(10)  If the political communication references a ballot

26

question, a description of the ballot question.

27

(11)  Any other information required by the department.

28

(d)  Copy of materials.--If requested by the department, the

29

sponsor shall provide the department with a copy of all

30

materials related to the independent expenditure, including

broadcast, cable or satellite schedules or scripts,

2

advertisements, pamphlets, circulars, flyers, brochures,

3

letterheads and other printed materials or matter.

4

(e)  Failure to file report.--A person who fails to file a

5

report in accordance with this section commits a misdemeanor

6

and, upon conviction, may be sentenced to pay a fine of not more

7

than $5,000, or to undergo imprisonment for not less than one

8

month or more than two years, or both.

9

Section 20.  Effective date.

10

This act shall take effect in 60 days.
