| AN ACT |
| |
1 | Amending Title 75 (Vehicles) of the Pennsylvania Consolidated |
2 | Statutes, defining "mobile phone"; providing for prohibiting |
3 | the use of mobile phones in school zones; and imposing a |
4 | penalty. |
5 | The General Assembly of the Commonwealth of Pennsylvania |
6 | hereby enacts as follows: |
7 | Section 1. Section 102 of Title 75 of the Pennsylvania |
8 | Consolidated Statutes is amended by adding a definition to read: |
9 | § 102. Definitions. |
10 | Subject to additional definitions contained in subsequent |
11 | provisions of this title which are applicable to specific |
12 | provisions of this title, the following words and phrases when |
13 | used in this title shall have, unless the context clearly |
14 | indicates otherwise, the meanings given to them in this section: |

16 | "Mobile phone." A telecommunications device that receives an |
17 | analog signal or digital signal, or both, and that is designed |
18 | for handheld use. |

1 | Section 2. Title 75 is amended by adding a section to read: |
2 | § 3316. Prohibiting use of mobile phones in school zones. |
3 | (a) General rule.--No driver may operate a vehicle or school |
4 | bus while using a mobile phone within a school zone when the |
5 | school zone lights are illuminated with intermittent flashes. |
6 | (b) Exceptions.--This section shall not apply to: |
7 | (1) Law enforcement officers and operators of emergency |
8 | vehicles when on duty and acting in their official |
9 | capacities. |
10 | (2) Other persons when they are reporting an accident or |
11 | emergency. |
12 | (c) Posting.--All school zones shall be posted with signs |
13 | designated by the department. |
14 | (d) Penalty.--A person who violates subsection (a) commits a |
15 | summary offense and shall, upon conviction, be sentenced to pay |
16 | a fine of $100. A conviction under this section shall not |
17 | constitute a moving violation unless the offense involves an |
18 | accident. |
19 | Section 3. This act shall take effect in 60 days. |
