| AN ACT |
| |
1 | Amending the act of August 26, 1971 (P.L.351, No.91), entitled |
2 | "An act providing for a State Lottery and administration |
3 | thereof; authorizing the creation of a State Lottery |
4 | Commission; prescribing its powers and duties; disposition of |
5 | funds; violations and penalties therefor; exemption of prizes |
6 | from State and local taxation and making an appropriation," |
7 | further providing for powers and duties of secretary; and |
8 | providing for reports. |
9 | The General Assembly of the Commonwealth of Pennsylvania |
10 | hereby enacts as follows: |
11 | Section 1. Section 303(a)(11) of the act of August 26, 1971 |
12 | (P.L.351, No.91), known as the State Lottery Law, renumbered and |
13 | amended November 21, 1996 (P.L.741, No.134), is amended to read: |
14 | Section 303. Powers and duties of secretary. |
15 | (a) Powers and duties enumerated.--In addition to the powers |
16 | and duties provided by law and the act of April 9, 1929 |
17 | (P.L.177, No.175), known as The Administrative Code of 1929, the |
18 | secretary shall have the power and it shall be his duty to |
19 | operate and administer the lottery, and to promulgate rules and |
20 | regulations governing the establishment and operation thereof, |

1 | including, but not limited to: |

3 | (11) The apportionment of the total revenues accruing |
4 | from the sale of lottery tickets or shares and from all other |
5 | sources among: |
6 | (i) the payment of prizes to the holders of winning |
7 | tickets or shares; |
8 | (ii) the payment of costs incurred in the operation |
9 | and administration of the lottery, including the expenses |
10 | of the division and the costs resulting from any contract |
11 | or contracts entered into for promotional, advertising or |
12 | operational services or for the purchase or lease of |
13 | lottery equipment and materials; and |
14 | (iv) for property tax relief and free or reduced |
15 | fare transit service for the elderly as provided in |
16 | section 311. [No] Prior to For fiscal years beginning | <-- |
17 | before July 1, 2015, no less than 27% of the total |
18 | revenues accruing from the sale of lottery tickets or |
19 | shares shall be dedicated to this subparagraph. |
20 | Subsequent to For fiscal years beginning after June 30, | <-- |
21 | 2015, no less than 30% of the total revenues accruing |
22 | from the sale of lottery tickets or shares shall be |
23 | dedicated to this subparagraph. |

25 | Section 2. The act is amended by adding a section to read: |
26 | Section 315. Report. |
27 | The Department of Revenue shall submit a report to the |
28 | Governor, the chairman and minority chairman of the |
29 | Appropriations Committee of the Senate, the chairman and |
30 | minority chairman of the Appropriations Committee of the House |

1 | of Representatives, the chairman and minority chairman of the |
2 | Aging and Youth Committee of the Senate and the chairman and |
3 | minority chairman of the Aging and Older Adult Services |
4 | Committee of the House of Representatives by June 1 of each |
5 | year. The report shall set forth current lottery profits and the |
6 | State Lottery's plan for increasing future profits. This report |
7 | shall be posted on the department's publicly accessible Internet |
8 | website. This section shall expire June 30, 2015. |
9 | Section 3. This act shall take effect July 1, 2011, or |
10 | immediately, whichever is later. |
