| AN ACT |
| |
1 | Amending the act of September 30, 1983 (P.L.160, No.39), |
2 | entitled "An act establishing salaries and compensation of |
3 | certain public officials including justices and judges of |
4 | Statewide courts, judges of courts of common pleas, judges of |
5 | the Philadelphia Municipal Court, judges of the Philadelphia |
6 | Traffic Court, district justices and the Governor, the |
7 | Lieutenant Governor, the State Treasurer, the Auditor |
8 | General, the Attorney General and certain other State |
9 | officers and the salary and certain expenses of the members |
10 | of the General Assembly; and repealing certain inconsistent |
11 | acts," eliminating cost-of-living increases in judicial |
12 | salaries, executive salaries and legislative salaries. |
13 | The General Assembly of the Commonwealth of Pennsylvania |
14 | hereby enacts as follows: |
15 | Section 1. The General Assembly finds and declares as |
16 | follows: |
17 | (1) There is an economic crisis in the nation in general |
18 | and in this Commonwealth in particular. The projected budget |
19 | deficit for the Commonwealth for fiscal year 2011-2012 is |
20 | approximately $5,000,000,000. |
21 | (2) In a time of economic crisis, automatic cost-of- |
22 | living increases for public officials do not make good sense. |
23 | (3) It is necessary to eliminate automatic cost-of- |

1 | living increases in judicial, executive and legislative |
2 | salaries. |
3 | Section 2. Section 2.1 of the act of September 30, 1983 |
4 | (P.L.160, No.39), known as the Public Official Compensation Law, |
5 | reenacted and amended November 16, 2005 (P.L.385, No.72), is |
6 | amended to read: |
7 | Section 2.1. Judicial salaries. |
8 | (a) Supreme Court.--The annual salary of the Chief Justice |
9 | of the Supreme Court shall be $123,000, and the annual salary of |
10 | each of the other justices of the Supreme Court shall be |
11 | $119,750. |
12 | (b) Superior Court.--The annual salary of the President |
13 | Judge of the Superior Court shall be $117,750, and the annual |
14 | salary of the other judges of the Superior Court shall be |
15 | $116,000. |
16 | (c) Commonwealth Court.--The annual salary of the President |
17 | Judge of the Commonwealth Court shall be $117,750. The annual |
18 | salary of each of the other judges of the Commonwealth Court |
19 | shall be $116,000. |
20 | (d) Courts of common pleas.-- |
21 | (1) The annual salary of a president judge of a court of |
22 | common pleas shall be fixed in accordance with the following |
23 | schedule: |
24 | (i) Allegheny County, $106,000. |
25 | (ii) Philadelphia County, $106,500. |
26 | (iii) Judicial districts having six or more judges, |
27 | $105,000. |
28 | (iv) Judicial districts having three to five judges, |
29 | $104,500. |
30 | (v) Judicial districts having one or two judges, |

1 | $104,000. |
2 | (vi) Administrative judges of the divisions of the |
3 | Court of Common Pleas of Philadelphia County with |
4 | divisions of six or more judges, $105,000. |
5 | (vii) Administrative judges of the divisions of the |
6 | Court of Common Pleas of Philadelphia County with |
7 | divisions of five or less judges, $104,500. |
8 | (viii) Administrative judges of the divisions of the |
9 | Court of Common Pleas of Allegheny County with divisions |
10 | of six or more judges, $105,000. |
11 | (ix) Administrative judges of the divisions of the |
12 | Court of Common Pleas of Allegheny County with divisions |
13 | of five or less judges, $104,500. |
14 | (2) The other judges of the courts of common pleas shall |
15 | be paid an annual salary of $104,000. |
16 | (e) Philadelphia Municipal Court.--The President Judge of |
17 | the Philadelphia Municipal Court shall receive an annual salary |
18 | of $103,000. The annual salary for the other judges of the |
19 | Philadelphia Municipal Court shall be $101,250. |
20 | (f) Philadelphia Traffic Court.--The President Judge of the |
21 | Philadelphia Traffic Court shall receive an annual salary of |
22 | $55,000. The annual salary for the other judges of the |
23 | Philadelphia Traffic Court shall be $54,500. |
24 | (g) Magisterial district judges.--A magisterial district |
25 | judge shall receive an annual salary payable by the Commonwealth |
26 | of $51,500. |
27 | (h) Senior judges.--The compensation of the senior judges |
28 | pursuant to 42 Pa.C.S. § 4121 (relating to assignment of judges) |
29 | shall be $315 per day. In any calendar year the amount of |
30 | compensation which a senior judge shall be permitted to earn as |

1 | a senior judge shall not when added to retirement income paid by |
2 | the Commonwealth for such senior judge exceed the compensation |
3 | payable by the Commonwealth to a judge then in regular active |
4 | service on the court from which said senior judge retired. A |
5 | senior judge who so elects may serve without being paid all or |
6 | any portion of the compensation provided by this section. |
7 | [(i) Annual cost-of-living adjustment.--Beginning January 1, |
8 | 1997, and each January 1 thereafter, the annual salaries under |
9 | subsections (a) through (h) shall be increased by the percentage |
10 | change in the Consumer Price Index for All Urban Consumers (CPI- |
11 | U) for the Pennsylvania, New Jersey, Delaware and Maryland area |
12 | for the most recent 12-month period for which figures have been |
13 | officially reported by the United States Department of Labor, |
14 | Bureau of Labor Statistics immediately prior to the date the |
15 | adjustment is due to take effect. The percentage increase and |
16 | salary amounts shall be determined prior to the annual effective |
17 | date of the adjustment by the Supreme Court and shall be |
18 | published in the Pennsylvania Bulletin by the Court |
19 | Administrator of Pennsylvania within 20 days of the date the |
20 | determination is made.] |
21 | Section 3. Section 3 of the act, amended October 19, 1995 |
22 | (P.L.324, No.51), and reenacted and amended November 16, 2005 |
23 | (P.L.385, No.72), is amended to read: |
24 | Section 3. Compensation of Governor and Lieutenant Governor; |
25 | State Treasurer; Auditor General; Attorney General; |
26 | Commissioners of the Pennsylvania Public Utility |
27 | Commission; and heads of departments. |
28 | (a) The Governor, the Lieutenant Governor and Cabinet.--The |
29 | annual salaries of the Governor, the Lieutenant Governor and the |
30 | heads of the departments shall be as follows: Governor, |

1 | $125,000; Lieutenant Governor, $105,000; Adjutant General, |
2 | $90,000; Secretary of Aging, $95,000; Secretary of Agriculture, |
3 | $90,000; Secretary of Banking, $90,000; Secretary of Community |
4 | and Economic Development, $95,000; Secretary of the |
5 | Commonwealth, $90,000; Secretary of Education, $100,000; |
6 | Secretary of Environmental Protection, $100,000; Secretary of |
7 | General Services, $95,000; Secretary of Health, $100,000; |
8 | Insurance Commissioner, $90,000; Secretary of Labor and |
9 | Industry, $100,000; Secretary of Public Welfare, $100,000; |
10 | Secretary of Revenue, $95,000; State Police Commissioner, |
11 | $95,000; Secretary of Transportation, $100,000; Secretary of |
12 | Corrections, $100,000; Secretary of Conservation and Natural |
13 | Resources $95,000. |
14 | (b) Compensation of State Treasurer, Auditor General and |
15 | Attorney General.--The annual salaries of the State Treasurer, |
16 | Auditor General and Attorney General shall be as follows: State |
17 | Treasurer, $104,000; Auditor General, $104,000; Attorney |
18 | General, $104,000. |
19 | (b.1) Compensation of members of boards and commission.--The |
20 | annual salaries of the members of boards and commission shall be |
21 | as follows: member of the Liquor Control Board, $48,800; |
22 | Chairman of the Liquor Control Board, $50,800; member of the |
23 | Civil Service Commission, $40,625; Chairman of the Civil Service |
24 | Commission, $40,625; member of the State Tax Equalization Board, |
25 | $16,250; Chairman of the State Tax Equalization Board, $17,500; |
26 | member of Milk Marketing Board, $15,625; Chairman of Milk |
27 | Marketing Board, $16,250; member of the Securities Commission, |
28 | $15,000; Chairman of the Securities Commission, $16,250; member |
29 | of the Athletic Commission, $12,500; Chairman of the Athletic |
30 | Commission, $13,125; member of the Board of Pardons, $11,500; |

1 | Chairman of the Board of Claims, $84,800; member of the Board of |
2 | Claims, $80,800. |
3 | (c) Additional compensation prohibited.--Neither the |
4 | Governor, Lieutenant Governor, State Treasurer, Auditor General |
5 | or Attorney General nor the head of any administrative |
6 | department nor member of any board or commission referenced |
7 | herein, shall receive any additional compensation for any |
8 | services rendered to the Commonwealth in any capacity. |
9 | (d) Compensation of commissioners of the Pennsylvania Public |
10 | Utility Commission.--Each of the commissioners of the |
11 | Pennsylvania Public Utility Commission shall receive an annual |
12 | salary commensurate with the annual salary received by the |
13 | Secretary of Commerce, except the chairman, who shall receive an |
14 | additional $2,500 per year. |
15 | [(e) Annual cost-of-living adjustment.--Beginning January 1, |
16 | 1997, and each January 1 thereafter, the stated annual salaries |
17 | of the Governor and Lieutenant Governor, the State Treasurer, |
18 | the Auditor General, the Attorney General and the heads of the |
19 | departments and members of boards and commissions denoted herein |
20 | shall be increased by an annual cost-of-living increase |
21 | calculated by applying the percentage change in the Consumer |
22 | Price Index for All Urban Consumers (CPI-U) for the |
23 | Pennsylvania, New Jersey, Delaware and Maryland area, for the |
24 | most recent 12-month period for which figures have been |
25 | officially reported by the United States Department of Labor, |
26 | Bureau of Labor Statistics immediately prior to the date the |
27 | adjustment is due to take effect, to the then current salary |
28 | amounts authorized. The percentage increase and the salary |
29 | amounts shall be determined by the Governor prior to the annual |
30 | effective date of the adjustment and shall be published by the |

1 | Secretary of the Budget in the Pennsylvania Bulletin within ten |
2 | days of the date the determination is made.] |
3 | Section 4. Section 4(d) and (d.1) of the act, reenacted |
4 | November 16, 2005 (P.L.385, No.72), are amended to read: |
5 | Section 4. Members of the General Assembly. |

7 | [(d) Subsequent annual cost-of-living adjustment for |
8 | members.--For the 12-month period beginning December 1, 1997, |
9 | through November 30, 1998, and for each like 12-month period |
10 | thereafter, the salary of the members of the General Assembly |
11 | shall be increased by an annual cost-of-living adjustment |
12 | calculated by applying the percentage change in the Consumer |
13 | Price Index for All Urban Consumers (CPI-U) for the |
14 | Pennsylvania, New Jersey, Delaware and Maryland area, for the |
15 | most recent 12-month period for which figures have been |
16 | officially reported by the United States Department of Labor, |
17 | Bureau of Labor Statistics immediately prior to the date the |
18 | adjustment is due to take effect, to the then current salary |
19 | amounts. The percentage increase and the new salary amounts |
20 | shall be determined jointly by the Chief Clerk of the Senate and |
21 | the Chief Clerk of the House of Representatives prior to the |
22 | annual effective date of the adjustment and shall be published |
23 | by them in the Pennsylvania Bulletin within ten days of the date |
24 | such determination is made. |
25 | (d.1) Subsequent annual cost-of-living adjustment for |
26 | officers and leaders.--For the 12-month period beginning |
27 | December 1, 1997, through November 30, 1998, and for each like |
28 | 12-month period thereafter, the additional compensation of the |
29 | officers and leaders of the General Assembly shall be increased |
30 | by an annual cost-of-living adjustment calculated by applying |

1 | the percentage change in the Consumer Price Index for All Urban |
2 | Consumers (CPI-U) for the Pennsylvania, New Jersey, Delaware and |
3 | Maryland area, for the most recent 12-month period for which |
4 | figures have been officially reported by the United States |
5 | Department of Labor, Bureau of Labor Statistics immediately |
6 | prior to the date the adjustment is due to take effect, to the |
7 | then current compensation. The percentage increase and the new |
8 | compensation amounts shall be determined jointly by the Chief |
9 | Clerk of the Senate and the Chief Clerk of the House of |
10 | Representatives prior to the annual effective date of the |
11 | adjustment and shall be published in the Pennsylvania Bulletin |
12 | within 20 days immediately prior to each cost-of-living increase |
13 | taking effect.] |
14 | Section 5. This act shall take effect immediately. |
