AN ACT

Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An

2

act relating to the public school system, including certain

3

provisions applicable as well to private and parochial

4

schools; amending, revising, consolidating and changing the

5

laws relating thereto," in preliminary provisions,

6

prohibiting student data collection.

The General Assembly of the Commonwealth of Pennsylvania

8

hereby enacts as follows:

Section 1. The act of March 10, 1949 (P.L.30, No.14), known

10

as the Public School Code of 1949, is amended by adding a

11

section to read:

Section 118. Student Data Collection Prohibited.--(a)

13

Notwithstanding any provision of law to the contrary, the

14

Department of Education shall not obtain from an institution of

15

higher education identifying information concerning a student

16

for any purpose.

17

(b)  For purposes of this section, the following words and

18

phrases shall have the following meanings:

"Identifying information"  shall mean any document,

photographic, pictorial or computer image of another person, or

2

any fact used to establish identity, including, but not limited

3

to, a name, birth   date, Social Security number, driver's license

4

number, nondriver governmental identification number, telephone

5

number, checking account number, savings account number, student

6

identification number, employe or payroll number, residence

7

address, mailing address or electronic signature.

"Institution of higher education"  includes any of the

9

following:

10

(1)  A community college operating under Article XIX-A.

11

(2)  A university within the State System of Higher

12

Education.

13

(3)  The Pennsylvania State University.

14

(4)  The University of Pittsburgh.

15

(5)  Temple University.

16

(6)  Lincoln University.

17

(7)  Any other institution that is hereafter designated as

18

"State-related" by the Commonwealth.

19

(8)  Any accredited private or independent college or

20

university.

21

(9)  Any private licensed school as defined in the act of

22

December 15, 1986 (P.L.1585, No.174), known as the "Private

23

Licensed Schools Act."

"Student"  shall mean a person who attends an institution of

25

higher education, whether enrolled on a full-time, part-time,

26

credit or noncredit basis.

Section 2.  This act shall take effect in 60 days.
