AN ACT

Amending Title 18 (Crimes and Offenses) of the Pennsylvania

2

Consolidated Statutes, further providing for the offense of

3

carrying a false identification card.

The General Assembly of the Commonwealth of Pennsylvania

5

hereby enacts as follows:

6

Section 1.  Section 6310.3 of Title 18 of the Pennsylvania

7

Consolidated Statutes is amended by adding subsections a

subsection to read:

§ 6310.3.  Carrying a false identification card.

(f)  Confiscation.--Any person authorized to sell

<--

12

(f)  Confiscation.--

<--

13

(1)  Any person who:

14

(i)  is authorized to sell liquor or malt or brewed

15

beverages under the act of April 12, 1951 (P.L.90,

16

No.21), known as the Liquor Code, or an agent, employee 

<--

17

or representative of the person, shall; and

<--

18

(ii)  verifies the ages of purchasers of liquor or

malt or brewed beverages by placing identification cards

2

through an electronic scanner

3

may confiscate an identification card that has been presented

<--

4

for the purposes of obtaining liquor or malt or brewed

5

beverages when there is a reasonable suspicion that a person

6

has presented an identification card as described in

7

subsection (a).

8

(2)  The identification card confiscated under this

<--

9

subsection shall be submitted to law enforcement personnel 

10

within 48 hours to make a determination of the validity of

<--

11

the identification card presented. The confiscation shall not

<--

12

impose civil or criminal liability upon an individual

13

confiscating the identification card.

14

(g)  Detention.--

15

(1)  Any person authorized to sell liquor or malt or

16

brewed beverages under the Liquor Code, or an agent, employee

17

or representative of the person, who has probable cause to

18

believe that an individual has attempted to obtain liquor or

19

malt or brewed beverages by using an identification card as

20

described in subsection (a) may detain the individual in a

21

reasonable manner for a reasonable time on or near the

22

premises for any of the following purposes:

23

(i)  To require the individual to identify himself.

24

(ii)  To verify the identification.

25

(iii)  To inform a peace officer so that criminal

26

proceedings under this subchapter may be instituted.

27

(2)  The detention under paragraph (1) shall not impose

28

civil or criminal liability upon the peace officer or the

29

person detaining the individual.

30

Section 2.  This act shall take effect in 60 days.
