| AN ACT |
| |
1 | Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An |
2 | act relating to the public school system, including certain |
3 | provisions applicable as well to private and parochial |
4 | schools; amending, revising, consolidating and changing the |
5 | laws relating thereto," further providing for election of |
6 | school directors. |
7 | The General Assembly of the Commonwealth of Pennsylvania |
8 | hereby enacts as follows: |
9 | Section 1. Section 301 of the act of March 10, 1949 (P.L.30, |
10 | No.14), known as the Public School Code of 1949, is amended to |
11 | read: |
12 | Section 301. Board of Directors; Election or Appointment.-- |
13 | (a) The public school system of the Commonwealth shall be |
14 | administered by a board of school directors, to be elected or |
15 | appointed, as hereinafter provided. At each election of school |
16 | directors, each qualified voter shall be entitled to cast one |
17 | vote for each school director to be elected. Any system |
18 | providing for cumulative voting for the office of school |
19 | director is hereby abolished. |
20 | (b) Except as provided in subsection (c), school directors |

1 | shall be elected in accordance with the act of June 3, 1937 |
2 | (P.L.1333, No.320), known as the "Pennsylvania Election Code." |
3 | (c) A primary election for school director nominations shall |
4 | not be held for the 2011 municipal elections and thereafter. |
5 | School directors shall be elected at the November municipal |
6 | election beginning in 2011. |
7 | (d) Notwithstanding section 951 of the "Pennsylvania |
8 | Election Code," nomination papers for the office of school |
9 | director shall be filed in the same manner as nominations of |
10 | candidates by political bodies or independent candidates, as |
11 | provided by the "Pennsylvania Election Code," without regard to |
12 | political party membership. Nomination papers for the office of |
13 | school director must include the signatures of a minimum of 250 | <-- |
14 | number of qualified electors, without regard to political party | <-- |
15 | affiliation. affiliation as follows: | <-- |
16 | (1) two hundred fifty for a school district of the first |
17 | class; |
18 | (2) two hundred for a school district of the first class A; |
19 | (3) one hundred for a school district of the second class; |
20 | (4) fifty for a school district of the third class; and |
21 | (5) twenty-five for a school district of the fourth class. |
22 | Section 2. Section 302.1(d) of the act, added December 19, |
23 | 1975 (P.L.511, No.150), is amended to read: |
24 | Section 302.1. School Board in First Class A School |
25 | Districts; Apportionment of Seats, and Numbers, Terms, and |
26 | Methods for Election of School Directors in First Class A School |
27 | Districts.-- |

30 | directors shall be nominated and elected in accordance with the |

4 | Section 3. All acts and parts of acts are repealed insofar |
5 | as they are inconsistent with this act. |
6 | Section 4. This act shall take effect as follows: |
7 | (1) The amendment of section 301 of the act shall take |
8 | effect December 31, 2010. |
9 | (2) The remainder of this act shall take effect in 60 |
10 | days. |
