| AN ACT |
| |
1 | Amending the act of August 15, 1961 (P.L.987, No.442), entitled |
2 | "An act relating to public works contracts; providing for |
3 | prevailing wages; imposing duties upon the Secretary of Labor |
4 | and Industry; providing remedies, penalties and repealing |
5 | existing laws," allowing local governments to remove |
6 | themselves from the jurisdiction of the act; and making |
7 | repeals. |
8 | The General Assembly of the Commonwealth of Pennsylvania |
9 | hereby enacts as follows: |
10 | Section 1. The act of August 15, 1961 (P.L.987, No.442), |
11 | known as the Pennsylvania Prevailing Wage Act, is amended by |
12 | adding a section to read: |
13 | Section 13.1. Local Option.--Notwithstanding any provision |
14 | of this act, a political subdivision may elect, by ordinance or |
15 | resolution, to remove itself from the jurisdiction of this act. |
16 | Upon adoption of an ordinance or resolution under this section, |
17 | the political subdivision shall notify the Department of Labor |
18 | and Industry in writing. The notice shall include the date that |
19 | the ordinance or resolution became effective. |
20 | Section 2. Repeals are as follows: |

1 | (1) The General Assembly declares that the repeal under |
2 | paragraph (2) is necessary to effectuate this act. |
3 | (2) Section 752 of the act of March 10, 1949 (P.L.30, |
4 | No.14), known as the Public School Code of 1949, is repealed |
5 | as to any political subdivision electing to opt out of the |
6 | jurisdiction of the act under section 13.1 of the act. |
7 | (3) All other acts and parts of acts are repealed |
8 | insofar as they are inconsistent with this act. |
9 | Section 3. This act shall take effect in 60 days. |
