A JOINT RESOLUTION

Proposing an amendment to the Constitution of the Commonwealth

2

of Pennsylvania, further providing for restrictions on

3

gasoline taxes and motor license fees.

The General Assembly of the Commonwealth of Pennsylvania

5

hereby resolves as follows:

6

Section 1.  The following amendment to the Constitution of

7

Pennsylvania is proposed in accordance with Article XI:

8

That section 11(a) of Article VIII be amended to read:

9

§ 11.  Gasoline taxes and motor license fees restricted.

(a)  All proceeds from gasoline and other motor fuel excise

11

taxes, motor vehicle registration fees and license taxes,

12

operators' license fees and other excise taxes imposed on

13

products used in motor transportation after providing therefrom

14

for (a) cost of administration and collection, (b) payment of

15

obligations incurred in the construction and reconstruction of

16

public highways and bridges shall be appropriated by the General

17

Assembly to agencies of the State or political subdivisions

18

thereof; and used solely for construction, reconstruction,

maintenance and repair of and safety on public highways and

2

bridges and costs and expenses incident thereto[,] and for

3

development, construction, reconstruction, maintenance and

4

repair of mass public transportation systems and costs and

5

expenses incident thereto, and for the payment of obligations

6

incurred for such purposes, and shall not be diverted by

7

transfer or otherwise to any other purpose, except that loans

8

may be made by the State from the proceeds of such taxes and

9

fees for a single period not exceeding eight months, but no such

10

loan shall be made within the period of one year from any

11

preceding loan, and every loan made in any fiscal year shall be

12

repayable within one month after the beginning of the next

13

fiscal year.

Section 2.  (a)  Upon the first passage by the General

16

Assembly of this proposed constitutional amendment, the

17

Secretary of the Commonwealth shall proceed immediately to

18

comply with the advertising requirements of section 1 of Article

19

XI of the Constitution of Pennsylvania and shall transmit the

20

required advertisements to two newspapers in every county in

21

which such newspapers are published in sufficient time after

22

passage of this proposed constitutional amendment.

(b)  Upon the second passage by the General Assembly of this

24

proposed constitutional amendment, the Secretary of the

25

Commonwealth shall proceed immediately to comply with the

26

advertising requirements of section 1 of Article XI of the

27

Constitution of Pennsylvania and shall transmit the required

28

advertisements to two newspapers in every county in which such

29

newspapers are published in sufficient time after passage of

30

this proposed constitutional amendment. The Secretary of the

Commonwealth shall submit this proposed constitutional amendment

to the qualified electors of this Commonwealth at the first

3

primary, general or municipal election which meets the

4

requirements of and is in conformance with section 1 of Article

5

XI of the Constitution of Pennsylvania and which occurs at least

6

three months after the proposed constitutional amendment is

7

passed by the General Assembly.
