A CONCURRENT RESOLUTION

Urging the New Jersey Senate and General Assembly to exempt

2

current employees from proposed legislation requiring New

3

Jersey State employees to reside in New Jersey.

WHEREAS, New Jersey Assemblyman Paul D. Moriarty,

5

Assemblywoman Celeste M. Riley and Assemblyman John J.

6

Burzichelli have introduced legislation in the New Jersey

7

General Assembly to require all employees of the executive,

8

legislative and judicial branches of government in the State of

9

New Jersey to have their principal residences in the State of

10

New Jersey; and

11

WHEREAS, The New Jersey Assembly legislation, A 2478, was

12

introduced on March 8, 2010, and was referred to the Assembly

13

State Government Committee; and

14

WHEREAS, New Jersey Senator Donald Norcross and Senator Kevin

15

J. O'Toole have introduced legislation in the New Jersey Senate

16

to require all employees of the executive, legislative and

judicial branches of government in the State of New Jersey to

2

have their principal residences in the State of New Jersey; and

3

WHEREAS, The New Jersey Senate legislation, S 1730, was

4

introduced on March 11, 2010, and was referred to the Senate

5

State Government Committee; and

6

WHEREAS, Many residents of the Commonwealth of Pennsylvania

7

would be adversely affected if either legislative proposal were

8

enacted; and

9

WHEREAS, Pennsylvania residents hold positions such as state,

10

county and local government employees as well as teachers,

11

firefighters and police officers in the State of New Jersey; and

12

WHEREAS, Pennsylvania residents would be required to reside

13

in New Jersey within four months of employment for new hires and

14

for two and one-half years for existing employees; and

15

WHEREAS, No grandfather clause is present in either proposed

16

bill to exempt current employees; and

17

WHEREAS, Pennsylvania residents would be forced into

18

unplanned, negative economic situations if the New Jersey

19

legislation were enacted; therefore be it

20

RESOLVED (the Senate concurring), That the General Assembly

21

of the Commonwealth of Pennsylvania urge the State of New Jersey

22

to exempt current employees from the residency requirement

23

proposed by the New Jersey legislature in S 1730 and A 2478; and

24

be it further

25

RESOLVED, That a copy of this resolution be transmitted to

26

the New Jersey Senate and General Assembly.
