A RESOLUTION

Recommending that the Department of Transportation and the

2

Pennsylvania Turnpike Commission do not resubmit their joint

3

application to the Federal Highway Administration for

4

authorization to toll Interstate 80.

5

WHEREAS, On September 11, 2008, the Federal Highway

6

Administration rejected Pennsylvania’s application to toll

7

Interstate 80, making it clear in its decision that

8

Pennsylvania’s proposal failed to meet the criteria of a Federal

9

pilot program permitting the tolling of interstates; and

10

WHEREAS, The Federal Highway Administration rejected

11

Pennsylvania’s application to toll Interstate 80 on the grounds

12

that the Pennsylvania Turnpike Commission’s payments to the

13

State were not based on a fair market valuation and were not

14

allowable as operating costs; and

15

WHEREAS, In the wake of its rejection of Pennsylvania’s

16

application to toll Interstate 80, the Federal Highway

17

Administration has proposed a new Federal regulation that

explicitly requires state departments of transportation to

2

obtain a fair market valuation as part of a toll concession

3

agreement;and

4

WHEREAS, In announcing their decision, Federal officials

5

indicated that reapplication by Pennsylvania would likely result

6

in the same decision; and

7

WHEREAS, Tolling Interstate 80 would have a devastating

8

effect on economic development in the already economically

9

depressed rural communities along the I-80 corridor and would

10

place a severe burden on both businesses and local residents;

11

and

12

WHEREAS, The nation’s interstate highway system was built

13

with taxpayer money; and

14

WHEREAS, Tolling interstate highways is tantamount to double

15

taxation; and

16

WHEREAS, In 2005 the Department of Transportation, with

17

assistance from the Pennsylvania Turnpike Commission, completed

18

an Interstate 80 Tolling Study which concluded that tolling I-80

19

was not recommended and should not be pursued; therefore be it

20

RESOLVED, That the House of Representatives accept the

21

decision of the Federal Highway Administration and discourage

22

the Department of Transportation and the Pennsylvania Turnpike

23

Commission from reapplying for Federal authorization to toll

24

Interstate 80.
