| AN ACT |
| |
1 | Amending Title 75 (Vehicles) of the Pennsylvania Consolidated |
2 | Statutes, in size, weight and load, further providing for |
3 | restrictions on use of highways and bridges. |
4 | The General Assembly of the Commonwealth of Pennsylvania |
5 | hereby enacts as follows: |
6 | Section 1. Section 4902(c) of Title 75 of the Pennsylvania |
7 | Consolidated Statutes is amended to read: |
8 | § 4902. Restrictions on use of highways and bridges. |

10 | (c) Permits and security.-- |
11 | (1) The Commonwealth and local authorities may issue |
12 | permits for movement of vehicles of size and weight in excess |
13 | of restrictions promulgated under subsections (a) and (b) |
14 | with respect to highways and bridges under their jurisdiction |
15 | and may require such undertaking or security as they deem |
16 | necessary to cover the cost of repairs and restoration |
17 | necessitated by the permitted movement of vehicles. In |
18 | reference to subsection (a), the Commonwealth and local |

1 | authorities shall not refuse to issue a permit with respect |
2 | to a highway under their jurisdiction if there is no |
3 | reasonable alternate route available. |
4 | (2) Any security required in favor of the Commonwealth |
5 | or local authorities for a paved highway in order to provide |
6 | for maintenance at a level consistent with the type of |
7 | highway shall be up to $250,000 per linear mile. |
8 | (3) For purposes of this section, "reasonable alternate |
9 | route" shall mean a route meeting the criteria set forth in |
10 | department regulations relating to traffic and engineering |
11 | studies. |

13 | Section 2. Any and all regulations are abrogated to the |
14 | extent of any inconsistency with this act. |
15 | Section 3. This act shall take effect in 60 days. |
