AN ACT

Amending Title 61 (Prisons and Parole) of the Pennsylvania

2

Consolidated Statutes, in probation and parole, further

3

providing for administrative action.

The General Assembly of the Commonwealth of Pennsylvania

5

hereby enacts as follows:

6

Section 1.  Section 6113(a)(2) and (b) of Title 61 of the

7

Pennsylvania Consolidated Statutes are amended and the section

8

is amended by adding a subsection to read:

9

§ 6113.  Board action.

(a)  Quorum.--

11

(2)  Except as provided in subsections (b), (c), (d) and

13

(e) and Chapter 45, no person shall be paroled, reparoled or

14

discharged from parole or have his parole revoked, except by

15

a majority of the entire membership of the board.

(b)  Panel decisions.--[The]

(1)  Except as set forth in paragraph (2), the board may

2

make decisions on parole, reparole, return or revocation in

3

panels of two persons.

4

(i)  A panel shall consist of one board member and

5

one hearing examiner or of two board members.

6

(ii)  Panels shall be appointed by the chairperson or

7

the chairperson's designee.

8

(2)  In cases involving a crime of violence, the board

9

shall make decisions on parole, reparole, return or

10

revocation in panels of five persons.

11

(i)  A panel shall consist of four board members and

12

one hearing examiner or of five board members.

13

(ii)  Panels shall be appointed by the chairperson or

14

the chairperson's designee.

(f)  Definition.--As used in this section, the term "crime of

17

violence" means any of the following:

18

(1)  An offense under:

19

(i)  18 Pa.C.S. Ch. 25 (relating to criminal

20

homicide);

21

(ii)  18 Pa.C.S. § 2702 (relating to aggravated

22

assault);

23

(iii)  18 Pa.C.S. § 3121 (relating to rape); or

24

(iv)  18 Pa.C.S. Ch. 37 (relating to robbery).

(2)  An offense committed with a firearm.

26

Section 2.  This act shall apply to decisions made on or

27

after the effective date of this section.

28

Section 3.  This act shall take effect in 60 days.
