A JOINT RESOLUTION

Proposing distinct amendments to the Constitution of the

2

Commonwealth of Pennsylvania, further providing for terms of

3

office of Governor, Attorney General, Auditor General and

4

State Treasurer.

The General Assembly of the Commonwealth of Pennsylvania

6

hereby resolves as follows:

7

Section 1.  The following amendments to the Constitution of

8

Pennsylvania is proposed in accordance with Article XI:

9

(1)  That section 3 of Article IV be amended to read:

10

§ 3.  Terms of office of Governor; number of terms.

11

The Governor shall hold his office during four years from the

12

third Tuesday of January next ensuing his election[. Except for

13

the Governor who may be in office when this amendment is

14

adopted, he] and shall be eligible to succeed himself [for one

15

additional term].

(2)  That section 4.1 of Article IV be amended to read:

§ 4.1.  Attorney General.

An Attorney General shall be chosen by the qualified electors

of the Commonwealth on the day the general election is held for

2

the Auditor General and State Treasurer; he shall hold his

3

office during four years from the third Tuesday of January next

4

ensuing his election and shall [not] be eligible to [serve

5

continuously for more than two successive terms] succeed

6

himself; he shall be the chief law officer of the Commonwealth

7

and shall exercise such powers and perform such duties as may be

8

imposed by law.

(3)  That section 18 of Article IV be amended to read:

§ 18.  Terms of office of Auditor General and State Treasurer;

11

number of terms; eligibility of State Treasurer to

12

become Auditor General.

The terms of the Auditor General and of the State Treasurer

14

shall each be four years from the third Tuesday of January next

15

ensuing his election. They shall be chosen by the qualified

16

electors of the Commonwealth at general elections [but] and 

17

shall [not] be eligible to [serve continuously for more than two

18

successive terms] succeed themselves. The State Treasurer shall

19

not be eligible to the office of Auditor General until four

20

years after he has been State Treasurer.

Section 2.  (a)  Upon the first passage by the General

22

Assembly of these proposed constitutional amendments, the

23

Secretary of the Commonwealth shall proceed immediately to

24

comply with the advertising requirements of section 1 of Article

25

XI of the Constitution of Pennsylvania and shall transmit the

26

required advertisements to two newspapers in every county in

27

which such newspapers are published in sufficient time after

28

passage of this proposed constitutional amendment.

(b)  Upon the second passage by the General Assembly of these

30

proposed constitutional amendments, the Secretary of the

Commonwealth shall proceed immediately to comply with the

2

advertising requirements of section 1 of Article XI of the

3

Constitution of Pennsylvania and shall transmit the required

4

advertisements to two newspapers in every county in which such

5

newspapers are published in sufficient time after passage of

6

this proposed constitutional amendment. The Secretary of the

7

Commonwealth shall submit this proposed constitutional amendment

8

to the qualified electors of this Commonwealth at the first

9

primary, general or municipal election which meets the

10

requirements of and is in conformance with section 1 of Article

11

XI of the Constitution of Pennsylvania and which occurs at least

12

three months after the proposed constitutional amendment is

13

passed by the General Assembly.
