| AN ACT |
| |
1 | Amending Title 18 (Crimes and Offenses) of the Pennsylvania |
2 | Consolidated Statutes, providing for sexual assault by |
3 | supervisor or custodian. |
4 | The General Assembly of the Commonwealth of Pennsylvania |
5 | hereby enacts as follows: |
6 | Section 1. Title 18 of the Pennsylvania Consolidated |
7 | Statutes is amended by adding a section to read: |
8 | § 3124.3. Sexual assault by a supervisor or custodian. |
9 | Except as provided in sections 3121 (relating to rape), |
10 | 3122.1 (relating to statutory sexual assault), 3123 (relating to |
11 | involuntary deviate sexual intercourse), 3124.1 (relating to |
12 | sexual assault), 3124.2 (relating to institutional sexual |
13 | assault) and 3125 (relating to aggravated indecent assault), an |
14 | actor commits a felony of the third degree when the actor |
15 | engages in sexual intercourse or indecent contact with an |
16 | individual: |
17 | (1) who is under 18 years of age and over 16 years of |

1 | age; and |
2 | (2) over whom the actor has supervisory, custodial or |
3 | disciplinary authority. |
4 | Section 2. This act shall take effect in 60 days. |
