| AN ACT |
| |
1 | Amending the act of November 10, 1999 (P.L.491, No.45), entitled |
2 | "An act establishing a uniform construction code; imposing |
3 | powers and duties on municipalities and the Department of |
4 | Labor and Industry; providing for enforcement; imposing |
5 | penalties; and making repeals," further providing for revised |
6 | or successor codes. |
7 | The General Assembly of the Commonwealth of Pennsylvania |
8 | hereby enacts as follows: |
9 | Section 1. Section 304(a) of the act of November 10, 1999 |
10 | (P.L.491, No.45), known as the Pennsylvania Construction Code |
11 | Act, amended October 9, 2008 (P.L.1386, No.106), is amended to |
12 | read: |
13 | Section 304. Revised or successor codes. |
14 | (a) Building code.-- |
15 | (1) Subject to sections 105(c) and (d), 301(a)(3), (4), |
16 | (5), (6) and (7), (c) and (d) and 302, by December 31 of the |
17 | year of the issuance of a new triennial ICC International |

1 | Building Code, or its successor building code, the department |
2 | shall promulgate regulations adopting the new code as the |
3 | Uniform Construction Code unless the council informs the |
4 | department that it should exclude any provisions of the |
5 | triennial code from the Uniform Construction Code. If the |
6 | council provides this notification, the department shall |
7 | submit regulations adopting the triennial code with |
8 | provisions omitted by the council under this section within |
9 | 90 days following council notification. |
10 | (2) Subject to sections 105(c) and (d), 301(a)(3), (4), |
11 | (5), (6) and (7), (c) and (d) and 302, by December 31 of the |
12 | year of issuance of a new triennial ICC International |
13 | Residential Code, or its successor building code, the |
14 | department shall promulgate regulations providing that all |
15 | detached one-family and two-family dwellings and one-family |
16 | townhouses that are not more than three stories in height and |
17 | their accessory structures may be designed in accordance with |
18 | that code or the Uniform Construction Code at the option of |
19 | the building permit applicant. The department shall |
20 | promulgate regulations adopting the new code as the Uniform |
21 | Construction Code unless the council informs the department |
22 | that it should exclude any provisions of the triennial code |
23 | from the Uniform Construction Code. If the council provides |
24 | this notification, the department shall submit regulations |
25 | adopting the triennial code with provisions omitted by the |
26 | council under this section within 90 days following council |
27 | notification. |
28 | (3) Notwithstanding the provisions of paragraphs (1) and |
29 | (2), the department shall not promulgate regulations adopting |
30 | the 2009 ICC International Building Code or the 2009 |

1 | International Residential Code, and the regulations adopting |
2 | the 2006 versions of those codes shall remain in effect until |
3 | December 31, 2012, and until such time as the department |
4 | shall adopt the 2012 triennial versions of those codes |
5 | pursuant to paragraphs (1) and (2). |
6 | Section 2. This act shall take effect in 60 days. |
