| AN ACT |
| |
1 | Amending Title 75 (Vehicles) of the Pennsylvania Consolidated |
2 | Statutes, further providing for vehicles exempt from | <-- |
3 | registration, for exemption of persons, entities and vehicles |
4 | from fees and for general requirements for other vehicles | <-- |
5 | transporting school children. |
6 | The General Assembly of the Commonwealth of Pennsylvania |
7 | hereby enacts as follows: |
8 | Section 1. Section 1901(c)(16) of Title 75 of the | <-- |
9 | Pennsylvania Consolidated Statutes is amended to read: |
10 | Section 1. Sections 1302(11), 1901(c)(16) and 4553(b) of | <-- |
11 | Title 75 of the Pennsylvania Consolidated Statutes are amended |
12 | to read: |
13 | § 1302. Vehicles exempt from registration. |
14 | The following types of vehicles are exempt from registration: |

16 | (11) Any trailer or semitrailer, including but not |

1 | limited to non-self-propelled special mobile equipment and |
2 | amusement rides constructed as an integral part of the |
3 | trailer chassis to create a single unit, to be used primarily |
4 | for off highway use and only operated incidentally upon the |
5 | highway. |

7 | § 1901. Exemption of persons, entities and vehicles from fees. |
8 | * * * |
9 | (c) Processing fee in lieu of registration fee.--No |
10 | registration fee shall be charged for vehicles registered by any |
11 | of the following but the department shall charge a fee of $10 to |
12 | cover the costs of processing for issuing or renewing the |
13 | registration: |

15 | (16) Any person who is retired and receiving social |
16 | security or other pension and whose total annual income does |
17 | not exceed $19,200. Unless the retired person is physically |
18 | or mentally incapable of driving the vehicle, the retired |
19 | person shall be the principal driver of the vehicle but may |
20 | from time to time authorize another person to drive the |
21 | vehicle in his or her stead. For purposes of this paragraph, |
22 | the term "income" shall not include a stipend received from |
23 | the Federal Government under the American Recovery and |
24 | Reinvestment Act of 2009 (Public Law 111-5, 123 Stat. 115). |

26 | § 4553. General requirements for other vehicles transporting | <-- |
27 | school children. |

29 | (b) School-chartered bus.--In addition to school buses, |
30 | school-chartered buses, which are designed to transport 16 or |
|
1 | more passengers, including the driver, and which are operated by |
2 | a person holding a certificate of the Pennsylvania Public |
3 | Utility Commission or the Interstate Commerce Commission, may be |
4 | used under a short-term contract with a school which has |
5 | acquired the exclusive use of the vehicle at a fixed charge to |
6 | [provide transportation of] transport school children to a |
7 | [special] school-related event, provided that the vehicle is not |
8 | used to transport school children to or from their residences or |
9 | designated bus stops. A school-chartered vehicle may be used |
10 | without restriction for the transportation of school children |
11 | with special needs as may be necessary to make reasonable |
12 | accommodations pursuant to the Americans with Disabilities Act |
13 | of 1990 (Public Law 101-336, 104 Stat. 327). |

15 | Section 2. This act shall take effect immediately. as | <-- |
16 | follows: |
17 | (1) The amendment of 75 Pa.C.S. § 4553(b) shall take |
18 | effect in 60 days. |
19 | (2) The remainder of this act shall take effect |
20 | immediately. |
