AN ACT

Amending the act of March 1, 1974 (P.L.90, No.24), entitled "An

2

act relating to the labeling, distribution, storage,

3

transportation, use, application and disposal of pesticides

4

and devices; providing for registration and examination of

5

such materials; the licensing of pesticide dealers and pest

6

management consultants and imposing penalties," further

7

providing for registration.

The General Assembly of the Commonwealth of Pennsylvania

9

hereby enacts as follows:

Section 1.  Section 5.1 of the act of March 1, 1974 (P.L.90,

11

No.24), known as the Pennsylvania Pesticide Control Act of 1973,

12

added December 12, 1986 (P.L.1542, No.167), is amended by adding

13

subsections to read:

Section 5.1.  Registration.--* * *

15

(j)  The department shall test pesticides to prevent the

16

occurrence of food-related illnesses in both humans and animals.

17

The department shall also test pesticides to determine the

18

existence of a threat to the food supply. The department shall

19

design a rapid response to any poison threat to the food supply.

(k)  The department shall share any relevant testing

2

information procured pursuant to subsection (j) with the

3

Department of Health, the Department of Environmental Protection

4

or any other agency that could provide the public a benefit from

5

the results of their testing.

Section 2.  This act shall take effect in 60 days.
