AN ACT

  

1

Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An

2

act relating to the public school system, including certain

3

provisions applicable as well to private and parochial

4

schools; amending, revising, consolidating and changing the

5

laws relating thereto," further providing for food allergy

reaction management in public schools local wellness policy

and for duties of the Department of Education.

The General Assembly of the Commonwealth of Pennsylvania

9

hereby enacts as follows:

10

Section 1.  The act of March 10, 1949 (P.L.30, No.14), known

as the Public School Code of 1949, is amended by adding a

12

section to read:

13

Section 528.  Food Allergy Reaction Management.--(a)  The

14

Department of Education shall research and publish food allergy

15

management guidelines to be used by each school district when

16

developing its own food allergy reaction management practices

17

and shall use National Medical Organizations like the American

18

Academy of Allergy, Asthma & Immunology (AAAAI) and the Food

Allergy Network in the development of these guidelines.

(b)  The Department of Education shall assist each school

3

district in applying for any available Federal grants relating

4

to food allergy reaction management at public schools.

5

(c)  The food allergy management guidelines must address the

6

following:

7

(1)  Requiring schools to direct parents to inform school

8

administrators regarding medical information and physician

9

directions for students who experience food allergies.

10

(2)  Educating teachers of students with food allergies about

11

the nature of the food allergies.

12

(3)  Educating teachers and principals on the issue of food

13

allergies in children.

14

(4)  Training teachers in cardiovascular pulmonary

15

resuscitation and, in the case where a school nurse is not

16

immediately available, in the administration of medication for

17

emergencies involving students with food allergies.

18

(5)  Allowing capable students with food allergies to carry

19

and self-administer their own medication during emergencies

20

involving food allergies under certain circumstances.

21

(6)  Updating medical information annually for students with

22

food allergies.

23

(7)  Teaching all students to understand the impact of food

24

allergies to allow them to empathize with students who have food

25

allergies.

26

(d)  Any teacher, principal, school nurse or other employe of

27

a school district who has received training from the school

28

district relating to its food allergy reaction guidelines and

29

who complies in good faith with the guidelines shall be immune

30

from liability as a result of an injury arising out of the

administration of medication to a student with food allergies.

Section 1.  Section 1422.1 of the act of March 10, 1949

(P.L.30, No.14), known as the Public School Code of 1949, added

4

July 11, 2006 (P.L.1092, No.114), is amended to read:

5

Section 1422.1.  Local Wellness Policy.--(a)  Not later than

6

the first day of the school year beginning after June 30, 2006,

7

each local education agency shall, pursuant to section 204 of

8

the Child Nutrition and WIC Reauthorization Act of 2004 (Public

9

Law 108-265, 118 Stat. 729), establish a local wellness policy

10

for schools within the local education agency.

11

(b)  A local education agency to which 22 Pa. Code § 4.13

12

(relating to strategic plans) applies shall include the local

13

wellness policy as part of the strategic plan required under 22

14

Pa. Code § 4.13.

15

(c)  A local education agency may submit its local wellness

16

policy or information on other initiatives regarding child

17

health, nutrition, food allergy management and physical

18

education to the Department of Education for inclusion in the

19

clearinghouse established under section 1422.3(3). an update to

20

the policy information may be done in concert with the scheduled

21

submission of the school district's strategic plan as required

22

under 22 Pa.Code § 4.13.

Section 2.  Section 1422.3 of the act, amended July 20, 2007

24

(P.L.278, No.45), is amended to read:

25

Section 1422.3.  Duties of Department of Education.--The

26

Department of Education shall, in order to promote initiatives

27

regarding child health, nutrition, food allergy management and

28

physical education:

29

(1)  To every extent possible, include programs related to

30

child health, nutrition, food allergy management and physical

education as part of the continuing professional education

2

courses, programs, activities or learning experiences required

3

under section 1205.2(f).

4

(2)  Collaborate with the Department of Health to apply for

5

Federal funds related to coordinated school health funding to

6

enhance initiatives regarding child health, nutrition, food

7

allergy management, physical education, local wellness policies

8

and advisory health councils.

9

(2.1)  Identify, notify and assist school districts to apply

10

for Federal and State funds related to child health, nutrition

11

and food allergy reaction management. The information can be

12

provided through the department's e-grant system.

13

(3)  Establish a clearinghouse of wellness policies and

14

information regarding child health, nutrition and physical

15

education submitted to the department by local education

16

agencies pursuant to section 1422.1(c). Such information shall

17

be made available on the department's Internet website.

18

(4)  To every extent possible, maintain information related

19

to teaching about nutrition, food allergy management and

20

obesity, which information shall include concepts of healthy

21

eating, including nutrient density and portion control, and the

22

physical, psychological and nutritional causes of obesity. Such

23

information shall be made available on the department's Internet

24

website.

(5)  Publish recommended nutritional guidelines for food and

26

beverages sold in schools on the department's Internet website

27

on or after the effective date of this clause.

28

(6)  In collaboration with the advisory health councils

29

created in section 1422, the department shall develop guidelines

30

for managing life-threatening food allergies in schools which

shall be published on the department's website. The guidelines

2

shall be published on the department's Internet website no later

3

than January 31, 2011. The guidelines shall assist the school

4

districts in addressing the following:

5

(i)  The scope of the problem of childhood allergies and its

6

impact on school student health.

7

(ii)  Types of detailed policies and protocols to help

8

prevent allergic reaction emergencies and deaths from

9

anaphylaxis in schools.

10

(iii)  The systematic planning and multi-disciplinary team

11

approach needed prior to school entry by the student with life-

12

threatening food allergies.

13

(iv)  The school district staff's role and necessary training

14

in preventing exposure to specific allergens.

15

(v)  Responsibilities of the parent or guardian, school staff

16

and the student's primary care provider for notice, consent and

17

documentation of administration of medication to a school

18

student with a food allergy.

19

(vi)  Emergency response protocols should a life-threatening

20

allergic event occur.

21

(vii)  The roles of specific staff members in the care of the

22

student with a life-threatening allergic condition.

23

Section 2 3.  This act shall take effect in 60 days.
