| AN ACT |
| |
1 | Amending the act of November 22, 1978 (P.L.1166, No.274), |
2 | entitled "An act establishing the Pennsylvania Commission on |
3 | Crime and Delinquency, providing for its powers and duties |
4 | establishing several advisory committees within the |
5 | commission and providing for their powers and duties," |
6 | further providing for the Pennsylvania Commission on Crime |
7 | and Delinquency. |
8 | The General Assembly of the Commonwealth of Pennsylvania |
9 | hereby enacts as follows: |
10 | Section 1. Section 2(b) of the act of November 22, 1978 |
11 | (P.L.1166, No.274), referred to as the Pennsylvania Commission |
12 | on Crime and Delinquency Law, amended June 22, 2001 (P.L.396, |
13 | No.30), is amended and the section is amended by adding a | <-- |
14 | subsection to read: |
15 | Section 2. Pennsylvania Commission on Crime and Delinquency. |

17 | (b) Composition.--The commission shall consist of the |
18 | following members: |

1 | (1) The Attorney General. |
2 | (2) The Chief Justice of Pennsylvania. |
3 | (3) The Court Administrator of Pennsylvania. |
4 | (4) A judge of a court of common pleas. |
5 | (5) Commissioner of State Police. |
6 | (6) The chairmen of the House and Senate Majority |
7 | Appropriations Committees. |
8 | (7) The chairman of the Juvenile Justice and Delinquency |
9 | Prevention Committee. |
10 | (8) Four members of the General Assembly, of whom one |
11 | shall be designated by, and serve at the pleasure of the |
12 | President pro tempore of the Senate, one by the Minority |
13 | Leader of the Senate, one by the Speaker of the House of |
14 | Representatives and one by the Minority Leader of the House |
15 | of Representatives. |
16 | (9) Seven members appointed by the Governor, one |
17 | representative of local law enforcement agencies, one |
18 | representative of local correctional facilities, one |
19 | representative of local elected officials, one district |
20 | attorney representative, one representative of county |
21 | sheriffs, one representative of a local victims' service |
22 | agency and one representative of county commissioners. |
23 | (10) Seven private citizens appointed by the Governor, |
24 | at least two of which serve on the Juvenile Justice and |
25 | Delinquency Prevention Committee. |
26 | (11) Secretary of Corrections. |
27 | (12) The Victim Advocate. |
28 | (13) Secretary of Public Welfare. |
29 | (14) Secretary of Education. |
30 | (15) Secretary of Health. |

1 | (16) Chairman of the Board of Probation and Parole. |
2 | (17) Executive Director of the Juvenile Court Judges' |
3 | Commission. |
4 | (18) Executive Director of the Pennsylvania Commission |
5 | on Sentencing. |
6 | [(18)] (19) Such additional members appointed by the |
7 | Governor as are necessary to implement programs authorized by |
8 | State and Federal law. |

10 | (h.1) Delegates.--A member of the General Assembly who is a | <-- |
11 | member of the commission may delegate an employee of the |
12 | Commonwealth to represent the member at meetings of the |
13 | commission. A delegate may lawfully vote and otherwise act on |
14 | behalf of the member. The delegation must be in writing and |
15 | delivered to the chairman and shall continue in effect until |
16 | revoked or amended in writing. |
