| AN ACT |
| |
1 | Amending Title 18 (Crimes and Offenses) of the Pennsylvania |
2 | Consolidated Statutes, in firearms and other dangerous |
3 | articles, prohibiting certain assault weapons. |
4 | The General Assembly of the Commonwealth of Pennsylvania |
5 | hereby enacts as follows: |
6 | Section 1. Title 18 of the Pennsylvania Consolidated |
7 | Statutes is amended by adding a section to read: |
8 | § 6121.1. Certain assault weapons prohibited. |
9 | (a) Offense defined.--Any person in this Commonwealth who |
10 | possesses, uses, controls, sells, transfers or manufactures or |
11 | obtains a license to possess, use, control, sell, transfer or |
12 | manufacture an assault weapon in this Commonwealth commits a |
13 | felony of the third degree. |
14 | (b) Exception.--The provisions of subsection (a) shall not |
15 | apply to a member of the armed forces of the United States or |
16 | the National Guard or a law enforcement officer while performing |
17 | official duties or traveling to or from an authorized place of |
18 | duty, provided that the possession of the assault weapon has |

1 | been duly authorized under applicable law, regulation or |
2 | military or law enforcement policy. |
3 | (c) Definition.--As used in this section, the term "assault |
4 | weapon" means a semiautomatic rifle known as an SKS with |
5 | detachable magazine or any part or combination of parts designed |
6 | or intended to convert a firearm into such semiautomatic rifle |
7 | or any combination of parts from which such semiautomatic rifle |
8 | may be readily assembled if those parts are in the possession or |
9 | under the control of the same person. |
10 | Section 2. This act shall take effect in 60 days. |
