AN ACT

  

1

Amending the act of June 28, 1995 (P.L.89, No.18), entitled "An

2

act creating the Department of Conservation and Natural

3

Resources consisting of certain functions of the Department

4

of Environmental Resources and the Department of Community

5

Affairs; renaming the Department of Environmental Resources

6

as the Department of Environmental Protection; defining the

7

role of the Environmental Quality Board in the Department of

8

Environmental Protection; making changes to responsibilities

9

of the State Conservation Commission and the Department of

10

Agriculture; transferring certain powers and duties to the

11

Department of Health; and repealing inconsistent acts," in

12

Department of Conservation and Natural Resources, further

13

providing for fees and charges.

The General Assembly of the Commonwealth of Pennsylvania

15

hereby enacts as follows:

16

Section 1.  Section 314 of the act of June 28, 1995 (P.L.89,

17

No.18), known as the Conservation and Natural Resources Act, is

18

amended to read:

Section 314.  Fees and charges.

20

(a)  General rule.--Whenever the department imposes fees or

21

charges for activities, admissions, uses or privileges,

22

including charges for concessions, at or relating to State

parks, such charges or fees shall be used solely for the

2

acquisition, maintenance, operation or administration of the

3

State park system and are hereby appropriated for such purposes.

(b)  Parking at and general admission to State parks.--

5

(1)  The department shall not adopt or impose any charges

6

or fees for parking or general admission to State parks

7

unless the charges were imposed prior to January 1, 1995.

8

(2)  The department may continue to impose and modify

9

parking charges and fees applicable to specific services or

10

units within the State park system which were imposed prior

11

to January 1, 1995, and may impose charges or fees for

12

admission to and for use of specific services and facilities

13

in State parks.

14

(c)  Trailer sites at State parks.--The department shall not

15

adopt or impose any charges or fees for use of trailer sites in

16

State parks by persons who are at least 80 years of age.

17

(d)  Previous powers of Environmental Quality Board.--The

18

department shall continue to exercise the powers previously

19

vested in the Environmental Quality Board regarding the

20

imposition of fees and charges for State parks and State

21

forests.

22

Section 2.  Any regulation is abrogated to the extent of any

23

inconsistency with this act.

24

Section 3.  This act shall take effect in 60 days.
