AN ACT

Amending Title 23 (Domestic Relations) of the Pennsylvania

2

Consolidated Statutes, in proceedings prior to petition to

3

adopt, further providing for grounds for involuntary

4

termination.

The General Assembly of the Commonwealth of Pennsylvania

6

hereby enacts as follows:

7

Section 1.  Section 2511(a)(9) of Title 23 of the

8

Pennsylvania Consolidated Statutes is amended and the subsection

9

is amended by adding a paragraph to read:

10

§ 2511.  Grounds for involuntary termination.

11

(a)  General rule.--The rights of a parent in regard to a

12

child may be terminated after a petition filed on any of the

13

following grounds:

(9)  The parent has been convicted of one of the

16

following in which the victim was a child of the parent:

17

(i)  an offense under 18 Pa.C.S. Ch. 25 (relating to

criminal homicide);

2

(ii)  a felony under 18 Pa.C.S. § 2702 (relating to

3

aggravated assault);

4

(iii)  a felony under 18 Pa.C.S. § 3121 (relating to

5

rape);

6

(iv)  a felony under 18 Pa.C.S. § 3122.1 (relating to

7

statutory sexual assault);

8

(v)  a felony under 18 Pa.C.S. § 3123 (relating to

9

involuntary deviate sexual intercourse);

10

(vi)  a felony under 18 Pa.C.S. § 3124.1 (relating to

11

sexual assault);

12

(vii)  a felony under 18 Pa.C.S. § 3125 (relating to

13

aggravated indecent assault);

14

(viii)  a misdemeanor under 18 Pa.C.S. § 3126

15

(relating to indecent assault);

16

(ix)  an offense in another jurisdiction equivalent

17

to an offense in subparagraph (i) [or], (ii), (iii),

18

(iv), (v), (vi), (vii), (viii); or

19

[(iv)] (x) an attempt, solicitation or conspiracy to

20

commit an offense in subparagraph (i), (ii) [or], (iii),

21

(iv), (v), (vi), (vii), (viii) or (ix).

(10)  The child has been and is currently removed from

23

the care of the parent under a court order or under a

24

voluntary agreement with an agency and a court, in a

25

proceeding under 42 Pa.C.S. Ch. 63 (relating to juvenile

26

matters), has previously determined that:

27

(i)  Aggravated circumstances as defined in 42

28

Pa.C.S. § 6302 (relating to definitions) exist.

29

(ii)  Reasonable efforts to reunify the child with

30

the parent are not required.
