AN ACT

Amending Title 74 (Transportation) of the Pennsylvania

2

Consolidated Statutes, providing for the implementation and

3

coordination of advanced multimodal traveler information

4

through 511 service and other means and for powers and duties

5

of the Department of Transportation.

The General Assembly of the Commonwealth of Pennsylvania

7

hereby enacts as follows:

8

Section 1.  Title 74 of the Pennsylvania Consolidated

9

Statutes is amended by adding a part to read:

§ 9101.  Definitions.

The following words and phrases when used in this chapter

3

shall have the meanings given to them in this section unless the

4

context clearly indicates otherwise:

5

"511" or "511 service."  Three-digit telecommunications

6

dialing to access an intelligent transportation system traveler

7

information service provided in this Commonwealth in accordance

8

with the Federal Communications Commission and the United States

9

Department of Transportation.

"Department."  The Department of Transportation of the

11

Commonwealth.

12

"Local authorities."  County, municipal and other local

13

boards or bodies having authority to enact laws relating to

14

traffic.

15

"Local transportation organization."  Any political

16

subdivision or any mass transportation, port, redevelopment or

17

airport authority now or hereafter organized under the laws of

18

this Commonwealth or pursuant to an interstate compact or

19

otherwise empowered to render, contract for the rendering of or

20

assist in the rendering of transportation service in a limited

21

area in this Commonwealth, even though it may also render or

22

assist in rendering transportation service in adjacent states,

23

or any nonprofit association of public transportation providers

24

within this Commonwealth.

"Transit entity."  A local transportation organization or

26

transportation company.

"Transportation company."  Any person, firm or corporation

28

rendering public passenger or public passenger and rail

29

transportation service, with or without the rendering of other

30

service, in this Commonwealth pursuant to common carrier

authorization from the Pennsylvania Public Utility Commission or

2

the Interstate Commerce Commission.

§ 9102.  Department role and responsibilities.

4

(a)  Role.--The department is designated the lead agency for

5

implementing 511 service and is the point of contact for

6

coordinating 511 service with telecommunications service

7

providers.

8

(b)  Responsibilities.--The department shall:

9

(1)  Implement and administer 511 service in this

10

Commonwealth.

11

(2)  Coordinate with the Pennsylvania Turnpike

12

Commission, local authorities and transit entities to provide

13

advanced multimodal traveler information through 511 service

14

and other means.

15

(3)  Enter into agreements or contracts with the

16

Pennsylvania Turnpike Commission, local authorities and

17

transit entities to share the costs of implementing and

18

administering 511 service in this Commonwealth.

19

(4)  Enter into other agreements or contracts relating to

20

511 service to offset the costs of implementing and

21

administering 511 service in this Commonwealth.

22

(5)  Promulgate rules and regulations as necessary to

23

implement this chapter.

24

Section 2.  This act shall take effect in 60 days.
