| AN ACT |
| |
1 | Amending Title 75 (Vehicles) of the Pennsylvania Consolidated |
2 | Statutes, prohibiting the use of mobile telephones by drivers |
3 | of school buses and school vehicles. |
4 | The General Assembly of the Commonwealth of Pennsylvania |
5 | hereby enacts as follows: |
6 | Section 1. Title 75 of the Pennsylvania Consolidated |
7 | Statutes is amended by adding a section to read: |
8 | § 3316. Prohibiting use of mobile telephones by drivers of |
9 | school bus and school vehicle. |
10 | (a) General rule.--Except as provided in subsection (b), no |
11 | driver shall operate a school bus or school vehicle on a highway |
12 | of this Commonwealth, which shall include Federal, State and |
13 | municipal highways, while using a mobile telephone. |
14 | (b) Exception.--This section shall not apply to a school bus |
15 | parked in a safe area off of a trafficway as defined in section |
16 | 102 (relating to definitions). |

1 | (c) Defense.--It shall be a defense to a prosecution brought |
2 | for a violation of this section that the driver had reason to |
3 | fear for the driver's safety, was reporting a traffic accident |
4 | or was making a "911" emergency call. |
5 | (d) Penalty.--A person who violates this section commits a |
6 | summary offense and shall, upon conviction, be sentenced to pay |
7 | a fine of $250. |
8 | Section 2. This act shall take effect in 60 days. |
