                                     AN ACT

     1  Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
     2     Statutes, prohibiting mobile phone use while operating a
     3     school vehicle; and imposing penalties.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Title 75 of the Pennsylvania Consolidated
     7  Statutes is amended by adding a section to read:
     8  § 3316.  Prohibiting use of mobile phones while operating a
     9             school vehicle.
    10     (a)  Restrictions.--No driver of a school bus, school-
    11  chartered bus or other bus being used for the exclusive
    12  transportation of school children as specified under section
    13  4553(a) and (b) (relating to general requirements for other
    14  vehicles transporting school children) shall use a mobile phone
    15  while operating the vehicle on a roadway or while children are
    16  embarking or disembarking from the vehicle.
    17     (b)  Exceptions.--This section shall not apply to persons who
    18  use a mobile phone for the sole purpose of reporting an accident

     1  or emergency.
     2     (c)  Penalty.--A person who violates subsection (a) commits a
     3  summary offense and shall, upon conviction, be sentenced to pay
     4  a fine of $100.
     5     (d)  Definitions.--As used in this section, the following
     6  words and phrases shall have the meanings given to them in this
     7  subsection:
     8     "Hands-free mobile telephone."  A telecommunications device
     9  that receives an analog signal or digital signal, or both, and
    10  is designed for use without being held by a person's hand while
    11  speaking into the device.
    12     "Mobile phone."  A telecommunications device that receives an
    13  analog signal or digital signal, or both, and that is designed
    14  for handheld use, or a hands-free mobile telephone.
    15     Section 2.  This act shall take effect in 60 days.
