SENATE BILL

No. 1609 Session of 2008

                                     AN ACT

     1  Designating a portion of Route 8 in the Borough of Etna,
     2     Allegheny County, as the Chief Warrant Officer Michael J.
     3     Novosel Memorial Highway; and making a related repeal.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6  Section 1.  Chief Warrant Officer Michael J. Novosel Memorial
     7                 Highway.
     8     (a)  Declaration of policy.--The General Assembly finds and
     9  declares as follows:
    10         (1)  On October 2, 1969, in the Kien Tuong Province,
    11     Republic of Vietnam, Chief Warrant Officer Michael J.
    12     Novosel, with conspicuous gallantry and intrepidity in action
    13     at the risk of his life and above and beyond the call of
    14     duty, distinguished himself while serving as commander of a
    15     medical evacuation helicopter.
    16         (2)  Chief Warrant Officer Novosel unhesitatingly
    17     maneuvered his helicopter into a heavily fortified and
    18     defended enemy training area where a group of wounded

     1     Vietnamese soldiers were pinned down by a large enemy force.
     2         (3)  On six occasions while flying without gunship or
     3     other cover and exposed to intense machine gun fire Chief
     4     Warrant Officer Novosel returned to the area in order to
     5     extract friendly troops.
     6         (4)  Near the end of the mission a wounded soldier was
     7     spotted close to an enemy bunker. Fully realizing that he
     8     would attract enemy fire, Chief Warrant Officer Novosel
     9     attempted and extracted the soldier while being injured
    10     himself.
    11         (5)  In all, 15 extractions were performed in order to
    12     remove wounded personnel. As a direct result of his selfless
    13     conduct, the lives of 29 soldiers were saved.
    14         (6)  The extraordinary heroism displayed by Chief Warrant
    15     Officer Novosel was an inspiration to his comrades in arms
    16     and reflects great credit on him, his unit and the United
    17     States Army.
    18     (b)  Designation.--Route 8 in the Borough of Etna, Allegheny
    19  County is hereby designated as the Chief Warrant Officer Michael
    20  J. Novosel Memorial Highway in recognition of the Medal of Honor
    21  recipient.
    22     (c)  Signs.--Department of Transportation shall erect and
    23  maintain appropriate signs to indicate the designation under
    24  subsection (b).
    25  Section 2.  Repeals.
    26     (a)  Intent.--The General Assembly declares that the repeal
    27  under subsection (b) is necessary to effectuate this act.
    28     (b)  Provision.--Section 9 of the act of December 9, 2002
    29  (P.L.1412, No.178), entitled "An act designating a portion of
    30  the Mon/Fayette Expressway, State Route 43, as the Yohogania

     1  County Courthouse Highway; designating the Mon/Fayette
     2  Expressway interchange connecting to Commonwealth Avenue and
     3  State Route 837 in the City of Duquesne as the First Sergeant
     4  Leonard Funk, Jr., Interchange; designating the Mon/Fayette
     5  Expressway interchange with East Pittsburgh-McKeesport Boulevard
     6  in North Versailles as the Captain Michael John Estocin
     7  Interchange; designating an interchange of the Mon/Fayette
     8  Expressway with I-376 in Monroeville, Westmoreland County, as
     9  the Captain James A. Graham Interchange; designating the half
    10  interchange including only the westbound Mon/Fayette Expressway
    11  to I-376 and eastbound I-376 to Mon/Fayette in the City of
    12  Pittsburgh as the Lance Corporal William R. Prom Interchange;
    13  designating the Mon/Fayette Expressway interchange with Sixth
    14  Street in Braddock as the Ensign Henry Clay Drexler Interchange;
    15  designating the half interchange of the Mon/Fayette Expressway,
    16  including only westbound off and eastbound on movements, with
    17  Second Avenue in the City of Pittsburgh as the Corporal Charles
    18  E. Kelly Interchange; designating the interchange with Business
    19  Route 22 in Wilkins Township, Allegheny County, as the Staff
    20  Sergeant John Minick Interchange; designating the half
    21  interchange with access road connecting to Thompson Run Road in
    22  Penn Hills Township as the Chief Warrant Officer Michael J.
    23  Novosel Interchange; designating the interchange with Second
    24  Avenue at the north end of Glenwood Bridge in the City of
    25  Pittsburgh as the Private First Class John 'Jack' Kelly
    26  Interchange; designating the interchange connecting Camp Hollow
    27  Road in West Mifflin and Pittsburgh-McKeesport Boulevard
    28  (Richland Avenue) in Dravosburg as the Private Franklin J.
    29  Phillips Interchange; designating a section of State Route 1011
    30  in Clearfield, Cameron and Elk Counties as the Quehanna Highway;

     1  and designating the interchange, Exit 44, at Route 136 and Dry
     2  Run Road in Washington County as the Staff Sergeant Karl Gorman
     3  Taylor, Sr., Interchange," is repealed.
     4  Section 3.  Effective date.
     5     This act shall take effect in 60 days.
