AN ACT
1 Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An
2 act relating to the public school system, including certain
3 provisions applicable as well to private and parochial
4 schools; amending, revising, consolidating and changing the
5 laws relating thereto," requiring criminal background checks.
6 The General Assembly of the Commonwealth of Pennsylvania
7 hereby enacts as follows:
8 Section 1. The act of March 10, 1949 (P.L.30, No.14), known
9 as the Public School Code of 1949, is amended by adding a
10 section to read:
11 Section 1606-A. Criminal Background Checks and Child Abuse
12 Clearances.--Beginning January 1, 2009, the association shall
13 require every applicant for certification, registration or
14 license by the association as a sports official and all
15 individuals currently approved to be a sports official to submit
16 a criminal background check as required under section 111 and an
17 official clearance statement required under 23 Pa.C.S. Ch. 63
18 Subch. C.2 (relating to background checks for employment in
19 schools). The employment prohibitions provided for under section
1 111 and 23 Pa.C.S. Ch. 63 Subch. C.2 shall also apply to all
2 applicants and current sports officials and an application shall
3 be denied accordingly and any current certification,
4 registration or license shall be revoked.
5 Section 2. This act shall take effect immediately.
