SENATE BILL

                                     AN ACT

     1  Amending the act of December 17, 1981 (P.L.435, No.135),
     2     entitled "An act providing for the regulation of pari-mutuel
     3     thoroughbred horse racing and harness horse racing
     4     activities; imposing certain taxes and providing for the
     5     disposition of funds from pari-mutuel tickets," further
     6     providing for the composition of the State Horse Racing
     7     Commission.

     8     The General Assembly of the Commonwealth of Pennsylvania
     9  hereby enacts as follows:
    10     Section 1.  Section 201(a) of the act of December 17, 1981
    11  (P.L.435, No.135), known as the Race Horse Industry Reform Act,
    12  is amended to read:
    13  Section 201.  Establishment of the commissions.
    14     (a)  The State Horse Racing Commission is hereby established
    15  as a departmental administrative commission within the
    16  Department of Agriculture. The commission shall have general
    17  jurisdiction over all pari-mutuel thoroughbred horse racing
    18  activities in the Commonwealth and the corporations engaged
    19  therein. For the purposes of this act, "thoroughbred horse
    20  racing" means that form of horse racing in which each

     1  participating horse is mounted by a jockey, is duly registered
     2  with the Jockey Club, New York, New York and engages in races on
     3  the flat. Thoroughbred horse racing may include a steeplechase
     4  or hurdle race. The commission shall consist of three members,
     5  not more than two of whom shall at the time of the appointment
     6  reside in the same county, who shall be appointed by the
     7  Governor, by and with the advice and consent of the Senate. Each
     8  commissioner shall hold office for a term of three years and
     9  until a successor is qualified.

    11     Section 2.  The provisions of this act shall apply to
    12  individuals nominated as members of the State Horse Racing
    13  Commission after the effective date of this act.
    14     Section 3.  This act shall take effect in 60 days.
