           WASHINGTON, WAUGH, D. WHITE, ARMSTRONG, BOSCOLA, BROWNE,
           BRUBAKER, COSTA, ERICKSON, FOLMER, LOGAN, MUSTO, RAFFERTY,
           REGOLA, RHOADES, STOUT, C. WILLIAMS, WOZNIAK AND M. WHITE,

        REFERRED TO JUDICIARY, AUGUST 4, 2008

                                     AN ACT

     1  Amending Title 42 (Judiciary and Judicial Procedure) of the
     2     Pennsylvania Consolidated Statutes, providing for sentencing
     3     for theft of veterans grave markers.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Title 42 of the Pennsylvania Consolidated
     7  Statutes is amended by adding a section to read:
     8  § 9720.3  Sentencing for theft of veterans grave markers.
     9     A person convicted of an offense under section 1913(l) of the
    10  act of August 9, 1955 (P.L.323, No.130), known as The County
    11  Code, and who, in the opinion of the sentencing court would
    12  benefit from supervised community service, shall be sentenced
    13  to, in addition to any other penalty authorized by law, a term
    14  of supervised community service in accordance with the
    15  following:
    16         (1)  If the loss of property is less than $200, the term
    17     of community service shall not be less than 50 days nor more

     1     than 74 eight-hour days.
     2         (2)  If the loss of property is at least $200 but less
     3     than $1,000, the term of community service shall not be less
     4     than 75 days nor more than 99 eight-hour days.
     5         (3)  If the loss of property is $1,000 or more, the term
     6     of community service shall not be less than 100 days nor more
     7     than 200 eight-hour days.
     8     Section 2.  This act shall take effect in 60 days.
