AN ACT
1 Amending the act of September 17, 1965 (P.L.521, No.272),
2 entitled "An act providing for the compiling, codifying,
3 recodifying and reenacting of ordinances in cities of the
4 second class A," prohibiting preemption of ordinances.
5 The General Assembly of the Commonwealth of Pennsylvania
6 hereby enacts as follows:
7 Section 1. Section 1 of the act of September 17, 1965
8 (P.L.521, No.272), entitled "An act providing for the compiling,
9 codifying, recodifying and reenacting of ordinances in cities of
10 the second class A," is amended by adding a subsection to read:
11 Section 1. * * *
12 (d) Notwithstanding any other provision of law, a city of
13 the second class A shall be authorized to enforce any ordinance
14 related to smoking enacted by the city before June 1, 2008. A
15 city of the second class A may not change or amend its ordinance
16 to conflict with any provision of the act of June 13, 2008 (P.L.
17 , No.27), known as the "Clean Indoor Air Act."
18 Section 2. This act shall take effect immediately.
