        INTRODUCED BY TOMLINSON, BOSCOLA, PILEGGI, CORMAN, LAVALLE,
           ERICKSON, GREENLEAF, KASUNIC, WOZNIAK, RHOADES, STOUT,
           KITCHEN, STACK AND WASHINGTON, MAY 22, 2008

        AS REPORTED FROM COMMITTEE ON PROFESSIONAL LICENSURE, HOUSE OF
           REPRESENTATIVES, AS AMENDED, JUNE 18, 2008

                                     AN ACT

     1  Amending the act of December 22, 1983 (P.L.306, No.84), entitled
     2     "An act providing for the State Board of Vehicle
     3     Manufacturers, Dealers and Salespersons; and providing
     4     penalties," providing for licensing cost.

     5     The General Assembly of the Commonwealth of Pennsylvania
     6  hereby enacts as follows:
     7     Section 1.  The act of December 22, 1983 (P.L.306, No.84),
     8  known as the Board of Vehicles Act, is amended by adding a
     9  section to read:
    10  Section 27.1  Licensing cost.
    11     (a)  Licensing cost.--Subject to the limitations established
    12  under subsection (c), a licensed dealer who has a contract with
    13  the Department of Transportation pursuant to 75 Pa.C.S. §
    14  1331(f)(6) (relating to issuance and reissuance of registration   <--
    15  plates) 7501 (RELATING TO AUTHORIZATION OF MESSENGER AND AGENT    <--
    16  SERVICES) may charge the purchaser of a vehicle a licensing cost
    17  permissible under 75 Pa.C.S. Ch. 19 (relating to fees) and the


     1  act of December 17, 1968 (P.L.1224, No.387), known as the Unfair
     2  Trade Practices and Consumer Protection Law and regulations
     3  promulgated thereunder, to include any of the following:
     4         (1)  The actual cost incurred by the dealer for fees
     5     associated with titling and registering the vehicle,
     6     including messenger fees, notary fees and electronic
     7     transaction fees.
     8         (2)  A documentary preparation charge for:
     9             (i)  Preparation and completion of documents required
    10         to register and license the vehicle under 75 Pa.C.S.
    11         (relating to vehicles).
    12             (ii)  Collection and submission of taxes payable by
    13         the purchaser.
    14             (iii)  Preparation of any other information
    15         associated with titling and registration of a vehicle.
    16     (b)  Out-of-State title.--The provisions of subsection (a)
    17  shall apply whether or not the purchaser intends to title and
    18  register the vehicle outside this Commonwealth.
    19     (c)  Limitations.--The following limitations shall apply:
    20         (1)  A dealer which provides electronic transaction
    21     services for documents under subsection (a)(2) may impose a
    22     maximum charge of $100 for calendar year 2008 and a maximum
    23     charge of $120 for calendar year 2009.
    24         (2)  A dealer which does not provide electronic
    25     transaction services for document preparation under
    26     subsection (a)(2) may impose a maximum charge of $80 for
    27     calendar year 2008 and a maximum charge of $100 for calendar
    28     year 2009.
    29     (d)  Adjustment.--Beginning in January 2010, and annually
    30  thereafter, the licensing cost for documentary preparation shall

     1  be adjusted in accordance with the Federal Consumer Price Index
     2  for All Urban Consumers (CPI-U) for all items as published by
     3  the United States Department of Labor, Bureau of Labor
     4  Statistics, for the previous 12-month period on a cumulative
     5  basis. Any adjustment which is less than 50¢ shall be rounded
     6  down to the next lowest dollar amount and any adjustment which
     7  is 50¢ or greater shall be rounded up to the next highest dollar
     8  amount.
     9     (e)  Fees.--Licensing costs under this section shall not be
    10  considered fees for purposes of section 30 or 31.
    11     Section 2.  This act shall take effect immediately.
