AN ACT 1 Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An 2 act relating to the public school system, including certain 3 provisions applicable as well to private and parochial 4 schools; amending, revising, consolidating and changing the 5 laws relating thereto," further providing for special 6 education payments to school districts. 7 The General Assembly of the Commonwealth of Pennsylvania 8 hereby enacts as follows: 9 Section 1. Sections 2509.1 and 2509.5 of the act of March 10 10, 1949 (P.L.30, No.14), known as the Public School Code of 11 1949, are amended by adding subsections to read: 12 Section 2509.1. Payments to Intermediate Units.--* * * 13 (b.16) Up to eleven million five hundred thousand dollars 14 ($11,500,000) may be utilized for programs administered and 15 operated by intermediate units during the 2008-2009 school year 16 for institutionalized children as established in subsection 17 (b.1). 18 * * * 19 Section 2509.5. Special Education Payments to School
1 Districts.--* * * 2 (zz) During the 2008-2009 school year, each school district 3 shall be paid the amount it received during the 2007-2008 school 4 year under subsections (vv), (ww), (xx) and (yy). 5 (aaa) During the 2008-2009 school year, twenty-seven million 6 eight hundred one thousand seven hundred seventy-two dollars 7 ($27,801,772) of the funds appropriated to the Department of 8 Education for special education shall be used to provide 9 supplemental funding for special education to all school 10 districts. Each school district shall receive a funding 11 supplement calculated as follows: 12 (1) multiply each school district's 2008-2009 market 13 value/income aid ratio by sixteen percent (16%) of its 2007-2008 14 average daily membership; 15 (2) multiply the product from paragraph (1) by twenty-six 16 million seven hundred thousand and two dollars ($26,700,002); 17 and 18 (3) divide the resultant product from paragraph (2) by the 19 sum of the products of the 2008-2009 market value/income aid 20 ratio multiplied by sixteen percent (16%) of the 2007-2008 21 average daily membership for all school districts. 22 (bbb) Each school district shall receive an inflation index 23 supplement as necessary so that the amounts under subsection 24 (aaa) and this subsection equal four and four tenths percent 25 (4.4%) multiplied by each school district's 2008-2009 market 26 value/income aid ratio of the amount in subsection (zz). 27 (ccc) Each school district for which the sum of the 28 supplements under subsections (aaa) and (bbb) provides an amount 29 less than two percent (2%) of the amount provided under 30 subsection (zz) shall receive additional funding as necessary so 20080S1374B1960 - 2 -
1 that the sum of the amounts provided under subsections (aaa) and 2 (bbb) and this subsection equals two percent (2%) of the amount 3 provided under subsection (zz). 4 Section 2. This act shall take effect July 1, 2008, or 5 immediately, whichever is later. A28L24RLE/20080S1374B1960 - 3 -
