AN ACT
1 Amending Title 4 (Amusements) of the Pennsylvania Consolidated
2 Statutes, further providing for the Pennsylvania Gaming
3 Economic Development and Tourism Fund.
4 The General Assembly of the Commonwealth of Pennsylvania
5 hereby enacts as follows:
6 Section 1. Section 1407(d) introductory paragraph of Title 4
7 of the Pennsylvania Consolidated Statutes is amended to read:
8 § 1407. Pennsylvania Gaming Economic Development and Tourism
9 Fund.

11 (d) Restrictions on projects for certain counties and
12 cities.--[For a ten-year period beginning with the first fiscal
13 year during which deposits are made into this fund, no] No
14 moneys from the Pennsylvania Gaming Economic Development and
15 Tourism Fund shall be distributed for any project located in a
16 city or county of the first or second class except as authorized
17 by this subsection. Moneys not used for the authorized projects
1 in cities and counties of the first and second classes may be 2 used throughout this Commonwealth. Moneys from any project which 3 is located in a city or county of the first or second class and 4 which are not authorized by this subsection shall not be 5 authorized or distributed until an amount equal to the amount 6 authorized to be financed under section 2 of the act of July 25, 7 2007 (P.L.342, No.53), known as the Pennsylvania Gaming Economic 8 Development and Tourism Fund Capital Budget Itemization Act of 9 2007, has been authorized and distributed for projects which are 10 not located in cities or counties of the first or second class. 11 Moneys from the fund for projects within cities and counties of 12 the first and second classes may only be used for the following 13 projects [during this ten-year period] until the requirements of 14 this subsection have been met: 15 * * * 16 Section 2.
