           M. WHITE, C. WILLIAMS, EARLL, RHOADES, A. WILLIAMS AND LOGAN,
           FEBRUARY 19, 2008

        AS AMENDED ON SECOND CONSIDERATION, JUNE 23, 2008

                                     AN ACT

     1  Amending Title 42 (Judiciary and Judicial Procedure) of the
     2     Pennsylvania Consolidated Statutes, providing for notice of
     3     convictions of college students.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Title 42 of the Pennsylvania Consolidated
     7  Statutes is amended by adding a section to read:
     8  § 1524.  Notice of convictions of college students.
     9     (a)  Notice.--Except as provided under subsection (b), a
    10  magisterial district judge shall provide written notice to an     <--
    11  educational A STATE-OWNED institution of a conviction of any      <--
    12  crime committed by a college student attending the educational    <--
    13  STATE-OWNED institution. This subsection shall only apply to a    <--
    14  crime that occurs in the host community in which the educational  <--
    15  STATE-OWNED institution is located.                               <--
    16     (b)  Exception.--
    17         (1)  A magisterial district judge is not required to


     1     provide notice, as provided under subsection (a), where the
     2     criminal violation involves a summary offense for a traffic
     3     violation under 75 Pa.C.S. (relating to vehicles).
     4         (2)  An A STATE-OWNED institution may also obtain notice   <--
     5     of a conviction through the Common Pleas Case Management
     6     System or similar system established by the Administrative
     7     Office of Pennsylvania Courts.
     8     (c)  Definitions.--As used in this section, the following
     9  words and phrases shall have the meanings given to them in this
    10  subsection:
    11     "Community college."  An institution created under Article     <--
    12  XIX-A of the act of March 10, 1949 (P.L.30, No.14), known as the
    13  Public School Code of 1949, or the former act of August 24, 1963
    14  (P.L.1132, No.484), known as the Community College Act of 1963.
    15     "Educational institution."  A State-owned institution, State-
    16  related institution or community college located in this
    17  Commonwealth.
    18     "Host community."  The borough, city, incorporated town or
    19  township where the educational STATE-OWNED institution is         <--
    20  located. The term shall include any adjacent community where
    21  off-campus student housing owned by or affiliated with the
    22  educational STATE-OWNED institution is located.                   <--
    23     "State-owned institution."  Any institution that is part of
    24  the State System of Higher Education under Article XX-A of the
    25  act of March 10, 1949 (P.L.30, No.14), known as the Public
    26  School Code of 1949.
    27     "State-related institution."  The Pennsylvania State           <--
    28  University, the University of Pittsburgh, Temple University and
    29  Lincoln University and their branch campuses.
    30     Section 2.  This act shall take effect in 60 days.
