AN ACT
1 Amending Title 42 (Judiciary and Judicial Procedure) of the
2 Pennsylvania Consolidated Statutes, providing for notice of
3 convictions of college students.
4 The General Assembly of the Commonwealth of Pennsylvania
5 hereby enacts as follows:
6 Section 1. Title 42 of the Pennsylvania Consolidated
7 Statutes is amended by adding a section to read:
8 § 1524. Notice of convictions of college students.
9 (a) Notice.--Except as provided under subsection (b), a
10 magisterial district judge shall provide written notice to an
11 educational institution of a conviction of any crime committed
12 by a college student attending the educational institution. This
13 subsection shall only apply to a crime that occurs in the host
14 community in which the educational institution is located.
15 (b) Exception.--A magisterial district judge is not required <--
16 to provide notice, as provided under subsection (a), where the
17 (B) EXCEPTION.-- <--
1 (1) A MAGISTERIAL DISTRICT JUDGE IS NOT REQUIRED TO
2 PROVIDE NOTICE, AS PROVIDED UNDER SUBSECTION (A), WHERE THE
3 criminal violation involves a summary offense for a traffic
4 violation under 75 Pa.C.S. (relating to vehicles).
5 (2) AN INSTITUTION MAY ALSO OBTAIN NOTICE OF A <--
6 CONVICTION THROUGH THE COMMON PLEAS CASE MANAGEMENT SYSTEM OR
7 SIMILAR SYSTEM ESTABLISHED BY THE ADMINISTRATIVE OFFICE OF
8 PENNSYLVANIA COURTS.
9 (c) Definitions.--As used in this section, the following
10 words and phrases shall have the meanings given to them in this
11 subsection:
12 "Community college." An institution created under Article
13 XIX-A of the act of March 10, 1949 (P.L.30, No.14), known as the
14 Public School Code of 1949, or the former act of August 24, 1963
15 (P.L.1132, No.484), known as the Community College Act of 1963.
16 "Educational institution." A State-owned institution, State-
17 related institution or community college located in this
18 Commonwealth.
19 "Host community." The borough, city, incorporated town or
20 township where the educational institution is located. The term
21 shall include any adjacent community where off-campus student
22 housing owned by or affiliated with the educational institution
23 is located.
24 "State-owned institution." Any institution that is part of
25 the State System of Higher Education under Article XX-A of the
26 act of March 10, 1949 (P.L.30, No.14), known as the Public
27 School Code of 1949.
28 "State-related institution." The Pennsylvania State
29 University, the University of Pittsburgh, Temple University and
30 Lincoln University and their branch campuses.

1 Section 2. This act shall take effect in 60 days.
