AN ACT
1 Amending Title 4 (Amusements) of the Pennsylvania Consolidated
2 Statutes, further providing for location of Category 2 slot
3 machine license.
4 The General Assembly of the Commonwealth of Pennsylvania
5 hereby enacts as follows:
6 Section 1. Section 1304(b)(1) of Title 4 of the Pennsylvania
7 Consolidated Statutes is amended to read:
8 § 1304. Category 2 slot machine license.

10 (b) Location.--
11 (1) Two Category 2 licensed facilities and no more shall
12 be located by the board within a city of the first class
13 provided that no facility within 14 linear miles of a
14 Category 1 facility, that has conducted over 200 racing days
15 per year for the two years immediately preceding the
16 effective date of this part, shall be located by the board
17 within 1,500 linear feet of the real property in which is
18 located a public, private or parochial school, a place of
1 worship, a recreation center or playground or a personal
2 residence, and one Category 2 licensed facility and no more
3 shall be located by the board within a city of the second
4 class. No Category 2 licensed facility located by the board
5 within a city of the first class shall be within ten linear
6 miles of a Category 1 licensed facility regardless of the
7 municipality where the Category 1 licensed facility is
8 located. Except for any Category 2 licensed facility located
9 by the board within a city of the first class or a city of
10 the second class, no Category 2 licensed facility shall be
11 located within 30 linear miles of any Category 1 licensed
12 facility that has conducted over 200 racing days per year for
13 the two calendar years immediately preceding the effective
14 date of this part and not within 20 linear miles of any other
15 Category 1 licensed facility. Except for any Category 2
16 licensed facility located by the board within a city of the
17 first class, no Category 2 licensed facility shall be located
18 within 20 linear miles of another Category 2 licensed
19 facility.

21 Section 2. This act shall take effect in 60 days.
