AN ACT 1 Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An 2 act relating to the public school system, including certain 3 provisions applicable as well to private and parochial 4 schools; amending, revising, consolidating and changing the 5 laws relating thereto," further providing for the educational 6 assistance program; AND, IN CHARTER SCHOOLS, FURTHER <-- 7 PROVIDING FOR ENROLLMENT. 8 The General Assembly of the Commonwealth of Pennsylvania 9 hereby enacts as follows: 10 Section 1. Section 1512-C of the act of March 10, 1949 <-- 11 (P.L.30, No.14), known as the Public School Code of 1949, is 12 amended by adding a subsection to read: 13 SECTION 1. SECTIONS 1512-C AND 1723-A OF THE ACT OF MARCH <-- 14 10, 1949 (P.L.30, NO.14), KNOWN AS THE PUBLIC SCHOOL CODE OF 15 1949, ARE AMENDED BY ADDING SUBSECTIONS TO READ: 16 Section 1512-C. Educational Assistance Program. 17 * * * 18 (j) Annual report.--No later than February 1, 2008, and 19 February 1 of each year thereafter, the department shall submit 20 a report to the chairmen and the minority chairmen of the
1 Appropriations Committee and the Education Committee of the 2 Senate and to the chairmen and the minority chairmen of the 3 Appropriations Committee and the Education Committee of the 4 House of Representatives summarizing the operation of the 5 educational assistance program for that fiscal year. The report 6 shall be included on the Department of Education's Internet 7 website. The report shall include: 8 (1) A listing of the providers approved under section 9 1505-C. 10 (2) For each provider approved under section 1505-C: 11 (i) The number of eligible school entities that have 12 entered into a contract with the provider. 13 (ii) The number of students for whom tutoring 14 services were provided, by grade level. 15 (iii) The assessment of academic progress conducted 16 by the department under subsection (f)(2). 17 (3) A listing of each eligible school entity. 18 (4) For each eligible school entity: 19 (i) The number of students eligible for tutoring 20 services, by grade level. 21 (ii) The number of students for whom tutoring 22 services were provided, by grade level. 23 (iii) The assessment of academic progress conducted 24 by the department under subsection (f)(2). 25 (5) A listing of each eligible school entity to which 26 the department has provided technical assistance under 27 subsection (f)(1). 28 Section 2. 1 CHARTER SCHOOL SHALL NOT BE SUBJECT TO A CAP OR OTHERWISE 2 LIMITED BY ANY PAST OR FUTURE ACTION OF A BOARD OF SCHOOL 3 DIRECTORS, A BOARD OF CONTROL ESTABLISHED UNDER ARTICLE XVII-B, 4 A SPECIAL BOARD OF CONTROL ESTABLISHED UNDER SECTION 692 OR ANY 5 OTHER GOVERNING AUTHORITY, UNLESS AGREED TO BY THE CHARTER 6 SCHOOL OR CYBER CHARTER SCHOOL AS PART OF A WRITTEN CHARTER 7 PURSUANT TO SECTION 1720-A. 8 (2) THE PROVISIONS OF THIS SUBSECTION SHALL APPLY TO A 9 CHARTER SCHOOL OR CYBER CHARTER SCHOOL REGARDLESS OF WHETHER THE 10 CHARTER WAS APPROVED PRIOR TO OR IS APPROVED SUBSEQUENT TO THE 11 EFFECTIVE DATE OF THIS SUBSECTION. 12 (3) THE PURPOSE OF THIS SUBSECTION IS TO CODIFY EXISTING 13 LAW. 14 SECTION 2. THE ADDITION OF SECTION 1723-A(D) OF THE ACT 15 SHALL BE RETROACTIVE TO JUNE 19, 1997. 16 SECTION 3. THIS ACT SHALL TAKE EFFECT IMMEDIATELY. D18L24DMS/20070S0805B1431 - 3 -
