AN ACT 1 Amending Title 18 (Crimes and Offenses) of the Pennsylvania 2 Consolidated Statutes, providing for an offense relating to <-- 3 fabricated airbags and fabricated airbag compartments. THE <-- 4 OFFENSE OF FRAUDULENT AIRBAGS. 5 The General Assembly of the Commonwealth of Pennsylvania 6 hereby enacts as follows: 7 Section 1. Title 18 of the Pennsylvania Consolidated 8 Statutes is amended by adding a section to read: 9 § 7331. Fabricated airbags and fabricated airbag compartments. <-- 10 § 7331. FRAUDULENT AIRBAGS. <-- 11 (a) Offense defined.--It is unlawful for any person to 12 knowingly purchase, sell, install or reinstall on a vehicle a 13 fabricated airbag or fabricated airbag compartment. FRAUDULENT <-- 14 AIRBAG. 15 (b) Grading.--Any person who violates subsection (a) commits 16 a misdemeanor of the first THIRD degree. <-- 17 (c) Definitions.--As used in this section, the following 18 words and phrases shall have the meanings given to them in this
1 subsection: 2 "Fabricated airbag." Any item "FRAUDULENT AIRBAG." ANY ITEM <-- 3 OR OBJECT, other than an airbag THAT WAS designed in accordance <-- 4 with Federal safety regulations for a given THE make, model and <-- 5 year of motor vehicle that is part of a motor vehicle THE <-- 6 inflatable restraint system FOR THE MOTOR VEHICLE. <-- 7 "Fabricated airbag compartment." An airbag compartment that <-- 8 is filled with any substance that does not function in the same 9 manner or to the same extent as an airbag designed in accordance 10 with Federal safety regulations for a given make, model and year 11 of motor vehicle to protect vehicle occupants in a vehicle 12 crash. The term does not include a compartment from which an 13 airbag has deployed if there is no concealment of the 14 deployment. 15 Section 2. This act shall take effect in 60 days.
